There is no advantage to filing separately that I can think of... As a citizen there is no priority date to be concerned about and I believe mailing one large package is generally cheaper than mailing multiple smaller ones.

Thank you for your reply!  The difference is that the I-130 can be filed online while the I-485 cannot.

Apparently a few people have filed I-130 online and then sent in the I-485 by mail.

In my case I could probably file the I-130 tonight and then move on to all the other forms, maybe get them done tomorrow or the next day.    In case we have any problem at least I could say we are part of the way finished.

You are on the right path , as this is USCIS proffered method ( their stated target is for all filings to be online in near future) and seems to speed through the process. Most recent VJ poster reported having the online filed I-130 approved in 42 days and the I-485 moving along nicely.

Good Luck, keep posting.

Thanks for sharing your view!  I did go ahead and do the I-130 online and a receipt was issued quickly.

Why aren’t you able to get married bird the I-94 expires?  Even if you get a marriage license and go to the justice of the peace, and follow with the formality later.  Why risk it??

Yes,  in some states the license becomes the certificate after it Is recorded,  but the majority issue a whole different piece of paper that you need to use to file.

TX is one of those states. I actually had trouble in another country, I had my TX marriage license (this is what it still says on top, but if one reads the whole document, it's clear I'm married), with a duly added apostille & the clerk took one look at it and said "This does not prove you are married this is just a permission to get married" & so far, no amount of explanation "of course it proves it, I received a GC and later US citizenship based on this marriage" has yet been successful....

Maybe next time when I try, I get so frustrated I give up on it for months (ironically it's to do with immigration to this other country LOL)

It's not worth the risk. There's always a chance if she over stays that she will be deported and denied readmission.

The K1 visa countdown starts the day she crosses into the USA.  If she needs to wait a month before entering the USA that's fine.

If it's important to you that your fiance stay in the USA you will adapt your plans to have your documents filed before the deadline.

Please note this is true for the quick Vegas marriage as well, and you will need to follow up for the Certified Copies

I can have certified copies within minutes of the ceremony. Have done it multiple times. If the couple really doesn't want to be fancy they can pick up their license at the marriage bureau, I can perform a ceremony outside the building, walk back in and record the marriage and come back outside with as many certified copies as they need. I could literally do it in less than 5 Minutes from start to finish. Doesn't get any quicker than that.

Here on a K1? Need married and a Certificate in hand within a few hours? I'm here to help. Come to Vegas and I'll marry you Vegas style!!   Visa Journey members are always FREE for my services. I know the costs involved in this whole game of immigration, and if I can save you some money I will!
