K1 VISA INTERVIEW VERY SOON (merged)

Hello to everyone, and thank you in advance for your responses. I have a quick question. I only have a tax return for 2020, but not for recent year. I'm working 2 jobs now, but I started one at the beginning of the year and the other one in March (making approximately $24,000 yearly, combining income of both jobs). I can provide a letter from my employer and also pay stubs. The thing is that I can't provide last year's tax return because I didn't have any income. I can now support my fiancé because I'm making more than it's needed and can also find someone to co-sponsor my fiancé. Would working 2 jobs and having a joint sponsor satisfy the income requirements or the last year income is very important? I have been suggested to file a non-income tax return. Should I file it?

If you had income in 2021, you will have to file taxes, deadline is around the corner. If no income, then state that you have no income.

You might have to get a joint sponsor. No income last year and income just above the cap this year.

 

FYI filing a non-income tax return might give you some credit from the stimulus.

I didn't get any stimulus check, nor do I have any income from last year. Should I still file the non employment tax form? I have a joint sponsor and I can even get 2 joint sponsor if they asked me to.

The choice is yours to make.

No income means you don't have a filing obligation but then there is the option to file even when you don't have income.

 

Due to covid, you might end up getting some money from the stimulus.

If you are eligible for stimulus, and want it, you have to file.

Please answer my question. Can someone sponsor more than 7 people? I have a joint sponsor (she make more than 60k yealry), but she is already sponsoring 7 other people. She makes more than enough to sponsor those people, but I'm worried about the NVC not accepting her as a joint sponsor for my case, since she is already sponsoring so many other people. My last year income was very very bad and I have been claimed too. But this year I will be making approximately 40,000. Any suggestions what would the NVC do to my case? Should I look for another joint sponsor or my current joint sponor is fine? 

 

I think we will get an interview date very soon.

It really depends.  On the I864, assuming you are the only immigrant they are sponsoring this time, the total number they will have to list would be a minimum of 9 (you, your sponsor, and the seven others unless any of them have since immigrating, naturalized).  This assume she has no other dependents.  The poverty guidelines for the I864 for 9 is $61,500, so you need to go over all the other details, or look for another sponsor.

They're not sponsoring me. They're only sponsoring my fiance. The joint sponsor informed us that 2 people out of 7 immigrants that she is sponsoring went to another country but she didn't withdraw their case. Should we provide someone sort of information about those 2 people going to another foreign country?

If in doubt, find another joint sponsor.  In deed, that will create a lengthy I-134 which could draw unwanted attention.  Good luck.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

NVC is not involved in a K-1 (except to assign a number)...or adjustment of status.

Yes, the above in bold is a legitimate concern. And I agree with @Crazy Cat that you should consider finding another cosponsor. Even if this cosponsor makes more than enough they can still not be accepted as a cosponsor based on the totality of circumstances.
