Should I file I-129F after I have filed I-130 for my spouse?

Hello all,

 

I am a US citizen and I have already filed an I-130 for my foreign spouse (NOA - 12/08/2021) at the TSC. The current processing times indicate 10-14months of wait time before my spouse can join me in the US. As I was looking through the forums, I did the see the option of filing the I-129F as well for perhaps a faster entry of my spouse into the US (current processing times indicate 3.5-7months). However, the USCIS website (https://www.uscis.gov/family/family-of-us-citizens/k-3k-4-nonimmigrant-visas) indicates that the need for a K3 visa is rare as the I-130 is processed faster. So, I am in a bit of conundrum as to whether I need to file I-129F or just wait for my I-130 to be adjudicated. Greatly appreciate any feedback you all can share!

it will be about 18 to 24 months for the person to get thru to interview 

and then India spouses go thru long security checks after interview of weeks,  months  or a year

 

u can file the 129 as many have done but it will be denied as the I 130 is all u need 

a few thought this speeded up the process / others report it was denied 

 

but your expectations of spouse being with u in 10 -14 months is not what will happen

 

India has a long queue of those already dq in the state 2  (NVC) and waiting for interview 

you need to go to the portal and check posts and timelines of india VJ members

The k3 is a dead visa. I've heard that others apply for a i129 k3 once they get the 130 approval, it causes something to speed up. Not sure of the details, you will have to use the search button to try to find this solution

For Texas it will take about 10-12 months before you get NOA2. Then your case will move to NVC (about 3 months if you provide the correct documentation first time round). Then you need to wait for the interview. I believe DQ to interview takes about a year. People DQ'ed in Feb 2021 are getting interviews right now. It might speed up in the future. 

 

The K3 is barely issued these days. But, some people believe if you submit the I-129F at the correct time it can speed up your I130 approval letter while others believe the only thing it achieves is giving USCIS more work and it slows down the process for everyone. 

 

Either way after you move to NVC stage you are looking at about another year before your partner is able to move to the US.

Thanks all for your very helpful responses. As an update, I did file the I-129F and it got referred to the VSC (No PD provided). However, the I-130 did move to the "being actively reviewed with no additional documents required at this time" status as of 03/05/2022. Does anyone here any experience as to approx. how long it would take from here to getting NOA2? Apart from waiting, anything I can do in the interim? TIA.

No way to know if filing the I-129F will have any impact on your timeline.  In the interim, do your homework on the NVC stage.

Not yet, unfortunately 😢. What do you mean by saying that K3 does not work for my case? Are you suggesting that the K3 will likely get rejected? Any additional insights will be helpful. TIA.

I-129F (K3) for some cases worked well since they got approved in a few months but your case seems did not work. But I would like to try since it is free and does not hurt anything.

I did file K3 on June 2022, already

got a receipt number case is processing at Cali center. Nothing happens to my I-130. I don’t think K3 works for me.

This seemed to work for me.  I think.  I also had two expedite requests denied. Something must’ve brought my application to the top of the stack. We were approved in 69 days. I’m stuck now because I’m waiting for the Italian government to provide the police background check clearance documents that NVC needs. Hint. Start working on that early, you might need it sooner than you think.
