Withdrawl of a K-1 Petition before filing a new CR1

Hello,

  I filed a K-1 petition on behalf of my then fiance back in 2020 and I received an email from the consulate that it was, "sent back to NVC for revocation, please contact USCIS for further instructions." I have contacted them multiple times and I am still wondering what to do before I proceed, as they didn't seem to have the answer I was looking for, neither have I received an official "NOIR.". We are now married and have decided to file a CR1 and would like to find out if we must have the K-1 visa withdrawn/cancelled before proceeding any further?

Here is a good tutorial on how to proceed.  Since it appears your K1/I129F has been sent back to USCIS, I would send the letter there.

I would file now, a long wait.

I would file the I-130 now along with a letter to officially withdraw the I-129F.  The K-1 process is now voided.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

marry and file  I 130 as crazy cat says

the K1 is allowed to die when it is sent back

email from the embassy is the only notice you will get 

still waiting for one for my K1 from 2009

 

NOIR is not sent out for K1

You don’t have to do anything but file your I130

I was in the same situation,  I filed I129F for fiance in SEP 2021.  I married her overseas in OCT 2021.  Then in NOV 2021 filed I130,  sent a letter to cancel K1 processing to USCIS, attached that in I130 online.   Of-course I have n't heard anything back from USCIS on K1 yet,  either revoked or anything...
