 I filed my ROC as joint filing in Jan,2020. Divorced in October,2021 and hired an attorney immediately to file the waiver. Though I submitted the necessary documents to him asap, attorney took more than a month to file the waiver. In the meanwhile my case status changed to 'interview scheduled' and right the same day my attorney sent my waiver petition to USCIS. Am already worried about this as I am not sure how USCIS takes me filing waiver after change in the case status.

 

Yesterday, I received my interview notice and now the attorney says he can't make it for the interview as he has other commitments on that day and asked me to hire his junior who has bad reviews. 

 

Am thinking to hire another attorney from a different law firm for the interview. Is it okay to hire a different attorney just for the interview especially when I sent my waiver documents 1-2 weeks ago from a different law firm ? Please throw some light if you have any experience or idea regarding this.

The presence of an attorney (and which specific attorney) has no impact on a decision made in your case.  It is decided upon based on your totality of circumstances, and that's it.

Thanks guys. I didn’t have an attorney for my temporary gc interview and I filed it by

myself. I filed the joint filing without an attorney too. 
 

My recent infopass appointment made me worried, the officer was not nice at all and my ex said she wrote letters to uscis against me. She also filed DV case on me which is dismissed, she also tried to pull lots of things during and right before separation like going to multiple DV shelters and complaining on me, complaining to her therapist that am a psycho blah blah and made therapist call me, text family and friends that am hurting her and even texting me all of a sudden that I married her for gc and ruined her life blah blah

 

I don’t think she can prove anything as she is the one who cheated on me, attached those proofs in waiver, after calling cops multiple times on me without any proof they finally filed a report on her and cps kicked her and my step daughter out of state to her grandma because of my ex’s drugs issues. I admitted her in multiple rehabs and attached bills in the waiver, but she recently wrote an email to my counselor that am bad blah blah and she should stop seeing me. Considering all this, am not sure how far she went to kick me out of states. 
 

Days before our separation, we were on a cruise in Caribbean and she was high and called security and told them that I married her for gc, trying to push her into the ocean and kidnapped my step daughter. They took few hours to figure out my step is with sitter, my wife is the one planned the trip and she is high. She pulled lots of stuff like this and again am sure she can’t prove anything but I just wanted to be on the safe side if VO surprise me with odd questions/behavior.

Sorry about the predicament you are in.  Having an attorney makes sense in that case.  To answer your original question, it should not matter which attorney you bring in, but make sure to get copies of all the filings your other attorney submitted, so any new attorney can review them prior to your interview.

get a lawyer as the following statement does not make sense

 

they finally filed a report on her and cps kicked her and my step daughter out of state to her grandma because of my ex’s drugs issues.

 

Child Protective Services  protects kids not send them out of state with a person with drug issues

Thank you very much. That’s what I was looking for, so I will start calling attorneys.  I got all the documents and cover letter from my current attorney’s office. Will get them reviewed by other attorney.

Thanks. I got where you are coming from because I probably used ‘kicked’ which I shouldn’t have but that’s not how a cps exactly works. At least from the two times I being there when my ex involved. 
 

cps doesn’t move kid to foster care or contact courts regarding parents immediately unless there is something huge. They start with family based safety programs, parenting classes, family group decision making, online courses etc. My ex involved in it twice and they ran some of these courses with her and as part of the family and the person living there I had to be in them too though I don’t have custody. Finally after she invited drug dealers to the house and they threatened me to kill, I called cops and they said she can bring anyone to the house as she is on the lease and they need search warrant if they want to search the house. I left the house and informed the same cps officer who is handling her case with pics of those random guys at home, she then went to my house told my ex that child needs to be somewhere safe with safer people and they asked me if I can come and I said I need a break from my ex and my daughter said she would like to stay with her grandma and uncle where she was raised and cps officer called me and said if I can provide my wife money, tickets etc as she gonna go there and drop kid and probably stay there with the family there for a while. I said yes and that’s how they left. After 3-4 months, they wanted to come and I booked flight tickets but my ex canceled trip at the last moment. And my step’s real father is a junkie and he was not in her life for long time. 
 

   I added the messages from cps officer regarding my ex’s travel and the pics I sent to her with some random guys. 
 

Added the flight tickets I booked for them but they didn’t come. 
 

   During separation until the divorce finalized, I sent my ex tens of thousands of dollars for her and my step whenever she asked me for different reasons like clothes for the kid, other items and sent birthday gifts to my step daughter. Added all that transactions too. 
 

During separation my step daughter sent me cards for my birthday, father’s day and my ex sent me for my birthday and fathers day. Added them all in the documentation too.
 

 Added messages from my ex’a mother who was saying sorry for my ex’s behavior and involvement with drugs and she kinda did the same thing like going to DV centers and calling cops on her and her ex bfs’. 

 

There was a time my wife was taken by some guy who she went to see for drugs and finally with her help of her family, friends and me cops helped her. Added those proofs that in the documentation too. Her posts on reddit trying to buy coke, messages from some women saying ‘stop sleeping with my husband’ and her posts on craiglist looking for hookups. Added all that in the waiver documentation. 
 

I sent my wife to multiple rehabs and even abroad for treatment, bought her a car and tens of thousands of worth jewelry ( she said she lost them all now and she totaled that car too) during our relationship and I added proofs of them in the documentation as well. 

I really don’t understand why uscis wants interview now with all the documentation. I am not sure people spent hundreds of thousands on sham marriages and more than that involving in all these issues and having mental stress. I even added all the AA meetings that she went where I accompanied her and a bunch of photos of our trips ( 3 of us). Am even going to counseling from 1.5 years because of this stress. I still think she is a good person when she is not high and I know her brain is not like others who isn’t addicted and that’s why I sent her money all these days and even as of today after divorce she is still on my phone plan. Hopefully uscis understands this.

Seems u have all the proof u need to ROC   

and u got a USC with some serious Issues 

 

As for USCIS and bringing all documentation  / its normal but usually people only have to show marriage is bona fida/  u have to go the extra step to show u were sincere and she was ify

Yup, I met multiple attorneys and they all said It’s good to prove to the uscis that I filed for divorce only after I tried hard to keep the marriage successful especially in this case as she is accusing me that I married her for gc and she might have already written  letters/emails to uscis.
