NOA2 for CD-1 (I-130) - waiting still.....

All,

 

I filed on Jan 1st and I am still waiting for the NOA2, a lot of others have theirs from JAN and FEB filers, but mine is still 'actively being looked at' since January 25th 2021.

My emails for VISAJOURNEY (as a guide) for the California Centre now say I am overdue and I could contact USCIS.

I am in the UK, my wife is in the USA, so its berst for her to contact them... but I am unsure what number to call - as I recall always getitng machine options and nevewr getitng through to someone.

 

Is anyone able to offer advice, experience etc?

Feeling very unsure and lacking in faith in the process as inforamation is thin on the ground.

Follow the USCIS processing times for your case and service center to get a  more accurate estimate of when you can expect to receive NOA2.

Sure - I looked there - but REALLY?

How do I interept this?

Either way - understand what you are sating and going back to my original question: I'd like to speak with someone at USCIS, using the messaging system on My USCIS is pointless. I've tried many times. It's not unreasonable to at least speak to a human about all this.

Call USCIS and ask for "technical assistance" at each prompt.  It will connect you to a human.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

In case you get connected to a live person, don't expect to get any more information other than what you see online on processing times. They would just say your case is within processing times and no action is needed.

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

The petition was only filed a few months ago, so you're probably just going to have to be patient at this point. I'm not sure what emails you are seeing that say you are "overdue" but the case is certainly not outside normal processing times (for any center) if your priority date is 1/1/2021 as your timeline shows.

I am sure its all 'normal' - but like I say, it gets hard when you see MARCH filers with NoA2 and think, if they are processed in order, whats the jam?

The estimates you are getting from VJ are probably based on recent cases being processed faster than before. But it's not so simple as things being processed in the order they were received - every case is different and some take longer to review than others. For every outlier case like the recent one that was approved in 31 days, there are others who have been waiting for 14 months.

 

Note that while your VJ timeline has that estimate of March-April, it also references the USCIS processing time estimates which are not currently as fast. It's also hard to know how service center transfers affect these times. Certainly feel free to contact USCIS to verify where the petition is being processed in order to be ready to send an inquiry if it ends up outside normal processing times (according to USCIS's estimates, not VJ's), but also be prepared to be patient.

Estimates/Stats :

Based on timeline data, your I130 may be adjudicated between March 20, 2021 and April 19, 2021*.

If this date range has passed or your application is past due per USCIS processing times then you should consider calling the USCIS to inquire on your petition. If you have been approved please update your timeline.

They might pick them up to review in order, but that doesn't mean they get approved in order.

Each case is special and there's something in 1 that could slow it down over others.

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

According to the message I just got from USCIS they said my file is

 

"....is pending at Nashville, TN Field Office and is within our current processing time."

 

What does this mean in terms of the process (pre-NOA2) as a whole?
