apply visit visa while IR 1 is in process.

Hello all,

 I got Documentary Qualified on 18 Feb 2021 and case the was filed on 3 Jan 2020.  

I was thinking to apply for visit visa instead,as it has already been too long.                                                                                           

Need suggestions/guidance if i should go for visit visa or wait for my turn.

If yes, for visit visa then what are the pros and cons.

What do you mean by “apply for a visit visa instead”? Instead of what? They are different visas for completely different purposes. The visit vida is for visiting. The CR-1 is for moving to the USA permanently. Is your embassy even scheduling B-2 visit visa appointments?

Most US embassies are not interviewing visitor visa applicants.  The US Embassy in Pakistan is probably not interviewing visitor visa applicants.  Even if they were interviewing non-immigrant visitor visa applicants, you are unlikely to get a visitor visa due to immigrant intent.  

 

Be patience and wait for your spousal immigrant visa.

If you have a spare $160, you can apply.  Unlikely you will get it, having clear immigrant intent.

by visit visa, I meant B2 visa category for tourism. Instead of wait for my appointment at Islamabad embassy for spouse visa and yes the embassy in Pakistan is issuing B 2 visas.

I wouldn't waste the $160.00.  Your chances are less than good.  What do you mean by "Instead of wait for my appointment....."?  You can't live in the US with a B2 visa, and you can't enter the US via a B2 visa with the intent to stay and adjust status.

According to the department of state, the current waiting time for a B-2 appointment in Islamabad is 304 days.

Your use of the word "instead" makes your question confusing. 

 

It looks like you are asking: Instead of waiting for the spousal visa process to complete, can I move to the US on a tourist visa? The answer is no. 

 

But you might asking: While we wait for the spousal visa process to complete, can I apply for a tourist visa so I can travel to the US for a short visit? The answer to this question is a bit more complicated. Many consulates are not processing tourist visa applications at the moment. And a tourist visa from Pakistan is unlikely to be approved, especially with a pending immigrant visa application. So in your case, the answer would still be no.

Section 214(b) is part of the Immigration and Nationality Act (INA). It states:

Every alien shall be presumed to be an immigrant until he establishes to the satisfaction of the consular officer, at the time of application for admission, that he is entitled to a nonimmigrant status...

Since you are DQ'd, you would get your spouse visa interview scheduled before a B2 visa interview.   Due to Covid, any embassy that opened prioritized spouse visas over any other types, except in Aug/Sep last year when they had to deal with student and diversity visas.  It would be a waste of $160.

I think it would be quite tough at this point to get a B2 visa. U can apply, but it’s highly unlikely that consulate would issue B2 visa while u r waiting for immigrant visa to get scheduled.

In my country they are processing visas for CR1 / IR1 faster than appointments for tourist visas.  Check the times in your country.  Patience touches us all
