Mortified after check bounced. Just got my NOA1

I am devastated that after waiting over 3 months for a NOA1, and finally getting a NOA1, my check did not cash. I do not know why. It was an official check from my bank. My account had the funds in it. There is no explanation what so ever I could give for this happening. I am crushed because I cannot apply again, three months ago we were able to prove that we had met within two years and now we cannot. They sent back the application and said we would have to refile. Is there any way possible we could petition this? This is horrible and I could vomit.

Unfortunately, the only way to file again is for you two to meet again.

It was signed, it was filled out correctly, written out to the US Dept. of Homeland Security. There has to be a way for them to take back the check right? Is there nothing we can do? We cannot meet again.

What do you mean by there has to be a way for them to take back the check? 

 

It's curious that they gave you no reason for rejecting the petition.  Usually there is a letter explaining why the petition was rejected.  If they told you that you had to refile, there has to be a reason why.


Unfortunately, there is nothing you can do unless you find an error on their part.  If the check bounced, I can't see how it's their fault.  


You will have to find a way to meet again if you want to file.

They sent a notice explaining that the bank I have did not honor the check or something. I am going to call the number and see if the application I just waited almost 4 months for can be resent with a new check.

How many times did they try to cash it?  Are you sure that is the reason for the rejected petition?

Unfortunately, if it has been greater than two years since you've met, you won't be able to refile without another meeting.

If you send it in again, you will get a rejection and possibly lose your $535.

 

You have to meet again.  There is no way around this requirement.

 

USCIS did not make a mistake.  Your bank refused payment.

You may be better off contacting the bank.  A recent post here on VJ was about USCIS trying cash the petition fee check x2, and then finally a third time.

 

I would not make sense at all that your check 'bounced' if there was money in the account.
