Hey all,

I have just seen my case status online and it is requesting more information.

I am so upset and annoyed as I paid an attorney to check and out baby is due next month.
I’ve come to terms with the extended waits but to think because of an error on my side will delay it further will frustrate me. I’m in the U.K. and my fiancé is in Florida.

so my question is will I have to wait another 9 months for NOA2?
I think I might crack up, my fiancé flys back to the states today so we will see what is in the letter. I have a feeling it is to do with a conviction he got at 21 being young and dumb and fleeing and eluding on a motorcycle.

OP

no one really knows

we don't know if USCIS will get the new fee schedule and be able to hire back the subcontractors who do much of the underlying work for immigration

we don't know what is going to happen with the new administration and the EO's and travel blocks

(understand that right know i live in the south and i am blocked from traveling to the northeast states by their governors)  this virus is handicapping not only immigration but every aspect of our life here and there)

we don't know how long the covid virus will interfere with normal life

and we don't know from your profile with no timeline how long you have already waited

what we do know is "it takes as long as it takes"

Not sure why you're being pressured into filling out your timeline. We're in unprecedented times, so filling it out isn't going to help you get any realistic idea on when you'll get through. You're just feeding stuff into their database for free.

Things are backed up because, over the past four years, they've gutted the immigration system and then COVID happened, which they then used as an excuse to make everything take even longer. While your problem might be because of something that happened when he was 21, it's also possible that it's because of how ridiculously long it takes to get through the system even if everything is perfect and nothing is weird about your case. Right now you just have to wait and see. No one really knows how long it's going to take at this point.

I'm not saying that you specifically were. It's just that, when it gets repeated in everyone's reply, it starts looking like it.

Their timeline won't even help them. USCIS is understaffed and even if they managed to make it to the NVC, considering that they're from a proclamation country, they wouldn't get processed anyway because DOS is using the proclamations to not process people. Their case isn't really going to go anywhere for a while.

Accurate timelines enable the algorithm that helps predict approval timelines. Plus it enables other members to know where someone is in the process.  K1 are being processed past the uscis stages in some countries.

Which supports my point that it's useless for them since they're in an unusual situation. It's just weird that people jumped on the timeline thing instead of providing an actual relevant answer.

The algorithm draws in people which means more ad views. It doesn't really help them in this situation.

First, you don't know what the requested information is. Second, we have seen many couples who have dotted all the "i's" and crossed their "t's" only to find out that they wanted more information that was not contained in the instructions, so don't blame the lawyer till you know where the disconnect is.

Technically speaking, an RFE is a written request for more information and documentation that USCIS mails out if they believe that they don’t yet have enough evidence to approve or deny a given application. An RFE normally is a minor item and should not be looked at like it's a denial but an opportunity for you to complete your application. USCIS would not send out an RFE if they were going to deny your application. It's just a step that they must take and once they have your information and it meets their approval then you should be seeing your NOA2.

There are many varying degrees of RFE's. Some as simple as not "ticking" off a question. Others forgot the fiancé(e) letter and then others who met on a website and now need to prove that it wasn't a marriage arrangement website.

Once you get your RFE, read over very carefully as you only have one chance to reply accurately without causing undue harm. Once you know FROM THE RFE what it is set out to correct and to include "everything" they are asking for. Then reread the RFE to ensure you are compliant. Make copies of everything for your record and send back using their instructions which are contained within the RFE. If the RFE requires a signature, PLEASE don't forget this. Include the original RFE letter along with a cover letter explaining what you are including in your reply. Like a checklist format. Once received at USCIS your case will begin adjudication where the agent had left off. No one can tell you how long it will take so be patient.

:time:

Im Digesting this all and will make sure I correct everything they have suggested. I really need to be extra cautious.
I am not expecting this process to be fast especially now the U.K. has a new strain of covid. However I’d like to make sure something as silly as me not signing a page doesn’t add further delay.

Thank you for the above information.

Thanks for your support and reply.

Yes being from a proclamation country will have huge implications and the U.K. new covid strain has really gone against me.
It’s  just ironic that my fiancé was able to fly over here in November and for Christmas. We are banned worldwide but still allowing everyone here on the condition they self isolate.

I will wait it out and hopefully get 3 months in the states for my maternity if I isolate in another country first.

I am not letting this getting me down.  I was annoyed there was an error and i didn’t spot it or the attorney.
like you said it could just be an admin game.

thanks a million for the help!!

*~*~*procedural question moved from “progress reports” to “process and procedures”*~*~*

Depending on what the RFE is for, I would definitely file a complaint against the attorney if they missed something on the form or did not include the correct documents. That won’t help your case move any faster but the lawyer should not be allowed to get away with a clerical error that costs you time and money.
