Great Twitter thread explaining the whole situation.

 

I wonder what will happen to you petitions without I-944s, filed in the last few weeks. It will be interesting to see if those petitions continue to be exempt from the I-944 or an RFE is issued to submit the I-944.

  1. 12/04/2023 - Application sent to USCIS Elgin, IL lockbox
  2. 12/07/2023 - Application received by USCIS
  3. 12/12/2023 - Received "Your case received" text message from USCIS. Receiipt # starts with IOE
  4. 12/13/2023 - Check cashed by USCIS
  5. 12/19/2023 - Received in mail the I797 with the receipt number and the online access code
  6. 12/19/2023 - Received in mail the bio-metric re-use notification
  7. 12/21/2023 - Received in mail the I797 NoA extending my green card by 48 months

I don't consider Twitter a reliable source for anything but extreme political opinions.......Having said that, I don't think they will require the I-944 for those applications submitted during the period of the ruling.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I think you should take a screenshot of USCIS website about I944 (link) and include that in your packet. As of today, I944 is not needed. So you should be good.

USCIS will know what rules/forms are required on the date the package is received.  

March 2, 2018  Married In Hong Kong

April 30, 2018  Mary moves from the Philippines to Mexico, Husband has MX Permanent Residency

June 15, 2018  I-130 DCF Appointment in Juarez  -  June 18, 2018  Approval E-Mail

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Back in August, i sent our package for the third time, The last rejection was due to the missing 944 but since they had taken that requirement away. I was able to submit it without it this time. I printed the page where it said it was not required. Today I saw a pending Charge of the 485 hit my credit. So far from all rejections, I never saw a pending charge. So this seem like positive news.

If you don't mind me asking, when did USCIS received your package?

Now with those two points in mind, what is your advise on answering question 61? I know people are sending screenshots of USCIS page along with application. However, are they answering YES to question 61 below, which will force you to explain or answering NO and still filing out the I-944 form?

09/25/2020 - Debit Card charged by USCIS

09/28/2020 - Received I-797C Rejection Notice in the Mail (reason: outdated I-765 form)

09/29/2020 - Received Text Message Receipts (I-485, I-130, I-131)

10/05/2020 - Received Hard Copy Mail Receipts (NOA?) (I-485, I-130, I-131)

10/12/2020 - Sent new I-765 form

10/14/2020 - New version of I-765 received in Chicago

03/10/2021 - Notice of Deficiency (Missing I-693 Medical Form)

06/25/2021 - Receive Biometrics Appointment Letter

07/23/2021 - Biometrics Appointment at Norfolk VA USCIS Office

07/23/2021 - 485 & 765 statuses changed to "Initial Review"

07/29/2021 - Interview Ready to Be Scheduled

08/13/2021 - Interview Scheduled for September 21st

09/21/2021 - Interview at USCIS Norfolk VA

09/21/2021 - Email saying “card produced and mailed”

09/24/2021 - Approval email sent for I-485

09/28/2021 - Green Card mailed by USCIS (email notification)

09/29/2021 - Green Card delivered to mailbox (also email notification)

10/01/2021 - I-765 rejected because “benefits were obtained via other means”

 

13 Months Total, No Lawyer or assistance besides USCIS website and VisaJourney, you can do it too!!!!
