i sent mine a little over two weeks ago, answered "NO" but also didn't include the i944.

That's what I was leaning towards with my reasoning.

Hahahaha i saw your post at that time.  Welcome to US. @retheem is also somewhere here. He still knows Swahili.

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

I don't consider Twitter a reliable source for anything but extreme political opinions.......Having said that, I don't think they will require the I-944 for those applications submitted during the period of the ruling.

I filed my AOS today. I did not Include I-944 😬

You did the right thing. You are not supposed to submit I-944 right now. I see your USCIS field office is in FL too (mine is Jax). I filed earlier this month and I am hoping the FL USCIS field offices are not terribly swamped like some of the other field offices are.

RoC Timeline:

  1. 12/04/2023 - Application sent to USCIS Elgin, IL lockbox
  2. 12/07/2023 - Application received by USCIS
  3. 12/12/2023 - Received "Your case received" text message from USCIS. Receiipt # starts with IOE
  4. 12/13/2023 - Check cashed by USCIS
  5. 12/19/2023 - Received in mail the I797 with the receipt number and the online access code
  6. 12/19/2023 - Received in mail the bio-metric re-use notification
  7. 12/21/2023 - Received in mail the I797 NoA extending my green card by 48 months

Reimplementation will not be retroactive

It turns out it will be retroactive: https://www.uscis.gov/green-card/green-card-processes-and-procedures/public-charge/injunction-of-the-inadmissibility-on-public-charge-grounds-final-rule "If you filed your Form I-485, Application to Register Permanent Residence or Adjust Status, after Feb. 24, 2020, you may be required to file Form I-944, Declaration of Self-Sufficiency. If we receive a Form I-485 before Oct. 13, 2020, that does not have all required forms and evidence, we will request any missing forms and evidence."

or an RFE is issued to submit the I-944.

Yes, USCIS would issue RFE.

So what does this mean? Wait and submit after the 13th and we do not have to provide I-944? I'm confused.

Oooo I get you now. No need to explain further.

It's all in the words.

Okay that makes sense.

Initially, you wrote before not after

The full paragraph for clarity: https://www.uscis.gov/green-card/green-card-processes-and-procedures/public-charge/injunction-of-the-inadmissibility-on-public-charge-grounds-final-rule

Yes. I got it. That's why I said no need to explain.  Hahaha it was all in the words (rejection or RFE depending on before or after the 13th)

I'm still grateful you explained.

Well, this is really bad for a lot of people.

Interesting use of the word "may" (bolded for emphasis):

"If you filed your Form I-485, Application to Register Permanent Residence or Adjust Status, after Feb. 24, 2020, you may be required to file Form I-944, Declaration of Self-Sufficiency."

Why not use stronger, more definitive language? ( like "you will be required...")
