Yes anyone is free to apply. Being approved isn’t a guarantee however.

A tourist visa is a b1/b2. You don’t get her it she has to apply on her own merits. It is difficult to make it clear she won’t stay in the US since she clearly has immigrant intent. She can have a document from work stating she can only take xx amount of days off or will return on xx date. So as you can see she is free to apply for it but it’s difficult to obtain. Additionally it’s very much possible the embassy isn’t issuing tourist visas at the moment.

B-2 visa allows a citizen of a foreign country to visit the United States for traveling purposes.

we would be thinking next spring anyhow

 

i would like to hear from anyone who has actually got (or not got) a B2 visa while waiting for green card.

 

it seems to me that someone would be stupid to overstay a B2 if they have already gone to the trouble and expense of applying for a IR1, if the person overstayed the B2 or worked illegally, they would automatically be denied the green card.

Those would not prohibit a spouse from adjusting status.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

The process is the same with ot with an application in process.

My recollection is that few people even attempt it....and even fewer succeed......but there is no harm in applying.........good luck.

not really, its pretty expensive to apply so if there is next to no chance of getting approved, i think we'll just save the money

$160 in the context of the fees and income requirements for an IR visa doesn’t seem that much...?
