I have been in the U.S for three years now. When I had my greencard interview two years ago, I was told by the officer at the time to apply to RENEW my greencard within 90 days of expiration.

So I applied to renew my greencard a month before it expired, went to biometrics and had everything done, only to have been denied two days ago and found out I was given the wrong information.


I got my greencard through a marriage. So I was actually supposed to file for Removal of conditions rather than renew my card.

The only issue now is that my greencard obviously expired in March (even though I applied for the wrong form a month before it’s expiration) and it could possibly get denied as we are now in August. 
 

ANOTHER silly issue that came up, is that I sent the correct form off yesterday, but I did not know that the biometrics fee is $85 ONTOP of the $595 filing fee, I thought it was all included! So I only sent off $595.


I called an officer today who said to wait for a rejection letter and then just send the $85.

 

My question is, has anyone been through something like this before and how did it go? And also, when I get the rejection, will they send the entire packet I sent to them back, so I can just add a note stating I forgot to add the biometrics fee, stick the $85 in and resubmit it?

can't answer your particular question

but you say you have been in US 3 years (there is no timeline on your profile so i don't don't when you entered)

but if you have been here 3 years and married to a USC (no type of visa stated on here either) why aren't you applying for naturalization?

Fees go up October 2nd considerably

I got married on a K1 fiancé visa June 2017, received my greencard March 2018. So I wouldn’t beable to apply for naturalization until March 2021 😪 - I actually have another account with all of my info on but because I hadn’t used it since I was working on my original greencard paperwork I’ve forgot my user and password

It's definitely the IO's fault for using the word "renew" rather than specifying I-751 Removal of Conditions. Nonetheless, there is also a warning on the I-90 page on USCIS' website saying that if you are a conditional resident (2-year GC), then the next step is Removal, not renewal. In any case, this mix-up still happens regularly. I would also suggest reading all instructions because yes biometrics are always an extra $85 on top of the form's actual filing fee. When you get the rejected package back, I would add a note stating you forgot biometrics AND you mistakenly filed I-90 instead of I-751 and that's why your I-751 is late.

If you became a permanent resident in March 2018, then you can APPLY for N-400 90 days before March 2021 (same as RoC).

OP hasn't been an LPR for 3 years. And either way he still needs to file his ROC no matter what, can't skip that process and jump straight to citizenship. 

 

OP, they will reject your whole package. When you receive it just make sure everything is still there, if not, just add what's missing. You will see stamps and notations on your documents and check, but you can send the same papers back to them again. No need to make a whole new package, just fix the stuff that needs to be fixed (another check for biometrics).

 

If you didn't do it the first time, you need to add an explanation as to why you're filing late. Your 90 day window has since long passed, so explain to them what happened.

Thank you, I sent this letter (as shown below) stating the reasoning behind my late filing for the I-751. I sent a money order check for $595 with the package too, so that should be fine to resend and just add a separate money order for $85 for the biometrics, along with a letter stating that I forgot the biometrics fee? (Sorry, I am just freaking out and trying to figure it all out. I don’t want to be denied just because of human error. 😞)

If you became a permanent resident in March 2018, then you can APPLY for N-400 90 days before March 2021 (same as RoC).

I added a letter explaining the situation that I applied to renew instead of remove conditions (in photo below.) I actually noticed that when I looked yesterday, however that notice on the I-90 page actually was not there when I filed back in February. So I’m guessing that it’s a common mistake?

 

When it comes to N-400, do I have to apply within the 90 day window, or can I apply for that whenever I am ready? (After the three year period)

You don't have to add an explanation for the missing biometrics fee, just add the payment. Only explain the late filing (like you already did). Also look through the whole package when they return it to make sure nothing was lost during the time it was still with USCIS. If something is missing, send another copy with the package when you ship it back.

 

Since your package will be returned, they won't cash the money order. Likely they will return it to you with the rest of the package. So you can just use the same money order and add an extra for the biometrics fee.

N400 (citizenship) eligibility works the same as RoC: 90 days BEFORE your three-year permanent resident anniversary. Read the guide here. Read the N400 instructions (not just the form). Read EVERYTHING. Put up 10 sticky notes with the correct dates. Whatever you need to do to make sure you don't forget. Do not apply for N400 early. They will take your money and then deny you.

 

I'm not sure which "notice" you're talking about on the I-90 page. I'm talking about the part in the middle of the page where it says, "DO NOT submit this form if you are a conditional permanent resident etc...". That's always been there.

I saw many people who does't mind to read carefully instructions of usics about filling. That's so sad

The instructions are pretty clear plus there is a fee calculator.  https://www.uscis.gov/feecalculator
