Sending in K-1 from overseas

Timeline

Hello everybody!

 

Me and my fiancé are getting ready to send in our K-1 packet, however I am currently visiting my fiancé in Mexico and I don't plan on leaving anytime soon. Will it be a problem if we send in our application from Mexico?

Did Mexico move?  I didn't think Mexico was overseas.

No need to send it to your mom first. Mail it directly to the drop box from where you are. You will need be domiciled in the US later in the process, but from the timeline you just described, you will have no problems with that. Good luck!

If you are together already, why not marry now and file for a spousal visa? There are so many advantages. The K-1 is ideal for couples who cannot be together anywhere but the USA or where the alien spouse cannot easily visit. If you file for a spousal visa, your wife will be a green card holder the minute she arrives and has all the privileges of that from day one. The K-1 leaves her in a limbo status for many, many months when she arrives.

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Because including the wait times for interviews in Mexico, the spousal visa will take about two years. Where as the k-1 will take a year (hopefully less) and then she can at least be in the US the rest of the time while we wait to get the green card. I am only in Mexico now because I just graduated school and I am waiting to take the bar exam in September and then start my job.

Your choice, I guess. Personally, the extra few months of waiting was more than worth it for me.

Please take a look at the current processing times for the spouse visa.  I thought our process would take 18-24 months total.  But we submitted the I-130 in Feb, got approved in May, and just finished submitting our documents to NVC.  Hopefully the NVC step will be done in a month and my wife can schedule her interview in July or August.  6 months total.

 

K1 is still 9-12 months, then 6-12 months for the AOS period afterwards.  Your fiance will not be able to travel at all after marriage, for on average 6 months for the AP/EAD.   No trips back to Mexico to see family or for you guys to take a short visit to Montreal or Niagara Falls (on the canadian side).   Of course, the trips to Canada would depend on the covid 19 situation.

There aren't a lot of data points here at VJ, but the average NOA2 to interview for Mexico among CR-1/IR-1 applicants who filled out their timelines in the last year is over 18 months (or nearly double Ukraine's average).

There aren't official per-embassy stats for this, I think.

you can send it and list the mothers address as your own if you will be staying there

I just want to note that I'm in the same situation! I've been in mexico with my fiance since right when the pandemic started. We're getting ready to send in our K1 materials from here this week. We'll be on a very similar timeline! Cheers!

That's awesome! How long have you been in Mexico? Are you listing a Mexican address as one of your physical addresses?
