Hi there,

 

I've seen a lot of users talk about getting married very shortly after landing in the U.S. and I am looking to hear from couples who married or plan to marry well into their 90 day period.  Our wedding date is September 6th, and our interview is March 30th. We are feeling pretty confident about an approval, but will be delaying his arrival into the country until mid June to accommodate our wedding plans for September. We will be right up into the 80s days of the 90 Visa before filing AOS

 

 

Is there anything we should be considering given we will be right up on the deadline? I confirmed with the courthouse that we can get a copy of our marriage certificate the same day we file our filled out license.

Just make sure he files the I-485 prior to the expiration of his I-94.  Most people would advise you to apply for a SSN very soon after arrival, then legally marry at a courthouse, apply for Adjustment of Status.......then have your ceremony later.......the sooner you file that I-485, the quicker everything else falls into place.

The I-94 expires 90 days after his admission into the U.S., correct?

Correct.....

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

The law says you have to marry within 90 days. It doesn’t require you to file AOS within the 90 days. USCIS will not throw out your AOS if they receive it on day 100. 
 

The thing to consider is you will not be able to work or get a driver license until your EAD is approved. You could get very bored and homesick in the 8-10 months of being in the US and being stuck at home with no transportation and nothing to do. I suppose there’s Uber.

Yes....but the sooner you marry, the sooner he can file the I-485, receive his EAD, and ultimately receive his Green Card....there is no benefit in waiting to marry.

This is why it is best to file the I-485 prior to the expiration of the I-94.

It is a personal decision; what is of "benefit" is entirely dependent upon individual value systems. We are choosing to wait to have a legitimate ceremony in front of all of our friends and families wherein we lawfully and religiously commit our lives to one another. Having our families as part of our day means more to us than having a sterile legal proceeding in a courthouse just because it's quicker.  We've waited this long... We can wait a couple more months to do it the way we want.  Just looking to get information on considerations in the AOS process.

He could enter a week or so before the wedding, he has 6 months from the Medical.

The important thing is that he knows what the deal is, can sort out stuff such as medical insurance etc etc.

We got married on day 75 and USCIS received our AOS package on day 88. So yes :P

And I should add that I had my k1 visa in my passport for 4 months before I entered the US. The timing worked out perfectly for our wedding that was already booked in advance (sounds like your situation is the same).

So good to know everything worked out! Congratulations. We wanted to have a traditional ceremony and reception just as we would have had had we been citizens of the same country, so we chose a wedding date we thought would reasonably fall within the 6 month period of his medical exam. Have the venue, reception, and all the services booked for that date. So far, everything seems to be going as planned! It's comforting to know you also waited a similar amount of time and everything turned out well.  Thanks!
