  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)

  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

Yes but it is for the beneficiary regardless inside or outside the US. They want to know if the beneficiary will have insurance within 30 days of arriving in the US as well as if the beneficiary has a job lined up and what the salary will be among other questions

So who fills this paper work out DS 5540. The beneficiary right ? In my case my husband is cuban ? He doesn't do taxes. What do I fill out then. Help me please.

Yes the beneficiary. Mark “no” where it asks if he has filled out taxes in the US the last 3 years

Thank you. And for income ? I mean Cuban doctors barely make 40 dollars a month. He works in a factory makes not even 20 a month.

I have just email the London embassy to enquire if they need the form DS5540 for my interview next Friday.

I emailed in the US embassy in Guyana as well. Will keep everyone posted. However , I am still going to fill it out just in case.

Where could you even find this form? I never heard of it until just a second ago on the forum and I got DQ 26th of February.

Seems odd that they are supposedly asking for it at the consular level considering it states that it's asked for at the USCIS stage:

On Feb. 24, 2020, USCIS is implemented the Inadmissibility on Public Charge Grounds final rule nationwide, including in Illinois. USCIS will apply the final rule to all applications and petitions postmarked (or, if applicable, submitted electronically) on or after that date. For applications and petitions sent by commercial courier (for example, UPS, FedEx, or DHL), the postmark date is the date reflected on the courier receipt. USCIS will reject any affected application or petition that does not adhere to the final rule, including those submitted by or on behalf of aliens living in Illinois, if postmarked on or after Feb. 24, 2020.  

 

If you've received your USCIS approval and have moved on to NVC stage, it shouldn't apply.  

 

Additionally, the proclamation on health care is still suspended.

DHS and DOS are two separate entities. USCIS is part of DHS and NVC and consular level is DOS. DOS has now also implemented the rule meaning it’s now also required at NVC and interview. NVC already has a document space for the DS5540 and like I said, I emailed the consulate they informed me it is also applied to the consular level for all interviews as well

Just leave it blank if you dont hv tax record in US, i just called the embassy yesterday, they said just leave it blank if it's not applicable to you.
