My question is about this part specifically “If you send your application or petition by commercial courier (for example, UPS, FedEx, or DHL), we will use the date on the courier receipt as the postmark date.”

 

We mailed our package before Feb 24, overnight shipping for Feb 22 delivery date, but on USCIS systems it says our forms were received Feb 24. We have already gotten EAD and case is ready to be scheduled for interview.

 

Do you think we will get RFE for I-944? 

 

I think it depends on how you sent it -- we had this issue when we sent our package. Only USPS has the ability to give a true postmark. We were hugely pressed for time so I called both UPS and FedEx and they both confirmed that they are unable to issue a postmark. If you sent it via USPS, then the postmark date is the date it was dropped off at the post office (our clerk was very sweet and stamped our box with the post-mark stamp like 4 times, in addition to the actual barcode sticker, so the date was very clear - 02/22)

 

If you sent it via FedEx or UPS, they can't issue a true postmark and so the date on the parcel was the date the package left the facility rather than the date it was received at the facility (the day you dropped it off). I know that the instructions say they'll use the receipt date (so hopefully you kept it!) but if you look back in the threads around late February/March when people were right at the deadline, a number of the packages that were sent by FedEx/UPS were rejected for not including the I-944, despite having the receipt to show they dropped it off prior to 02/24. The line you quoted was a big talking point but I'm not sure how many people were actually successful in fighting the rejections.

 

This is just what we were told, and it was confirmed when I asked the USPS clerk as well, but to me it sounds like it could be open to interpretation by the CO who has your file.

That’s really helpful, thank you!! Hopefully since it was accepted then without the form, that means we’re good to go. I wish they made it more clear that Fedex doesn’t have a true postmark date, otherwise we would have used USPS! If we end up getting an RFE for it, I will update the group.

Right! I think that's why USCIS includes the bit about using the receipt date, because the receipt date will show the day you dropped it off vs. the posting date which would be the date it leaves the FedEx/UPS facility. We drove an extra eight hours (16 round trip) to make sure that we got our package to USPS before they closed at 1pm on a Saturday to get in before the deadline. It's a wild story 🤪.

Calling a tier one to try to get a call back from a tier two -- I ended up receiving the job I interviewed for a few weeks ago and they offered me a salary that is absolutely worth trying to fight for. So.. wish me luck! 😅 Already a 45 min wait time just to talk to a tier 1 "information specialist".

Right so update on biometrics -- the tier 2 officer I spoke with was extremely rude, interrupted me a number of times while I was explaining, and said that she hadn't even heard of the "waiting 90 days past ASC opening".

 

She said there's literally nothing we can do but wait until it's scheduled. I asked whether or not I can call on day 91 for an inquiry and she repeated that they don't schedule biometrics so there's nothing to do but wait. So that's frustrating AF because we all know tier two officers can schedule biometrics appointments.

I've read on reddit ppl getting biometrics appt with tier 2 but this guy's tried for a whole week to get a good tier 2 who was willing to do something. It's annoying that some of them are willing to do something while other don't give AF about us.

 

Maybe try again? I know it's really frustrating and it shouldn't work this way but what else can we do? I'm on the same boat and waiting for a tier 2 call.

So, continuing on that... I got a call back from tier 2, asked about biometrics, told him that ppl were able to schedule appts with tier 2 and he told me that they usually are able schedule when they got it canceled or they either need to reschedule again. He said he didn't have the authority of scheduling a appt out of nowhere, unless you are in those situations. He even talked to his supervisor about it and the last thing he did was to put a request to expedite the biometrics appt and he said to call again if the expedite does not work. At least he was nice and explained all of that.
