Having now read some of your previous posts, although the details are muddled, one thing that came through clearly is that you may not have submitted documentation that met the Embassy's request for further information.  You submitted what you considered "proof" that what they were questioning was not true, but the consular officer may have not agreed that it proved what you said it did.

I appreciate the feed back. No one filed another petition for her. All of this craziness is due to one person. This person has got so much hate in his heart he has created all of this madness. This dude has been messing with the outcomes with a lot of things. He is typical Andy man wjho puts his hands in women and blames her for why he’s doing that. I’ll I’m trying to do is get married and have a nice happy life.

It seems you have a lot on your hands. You are not only dealing with immigration but also a spiteful ex that is through wrenches in the process. 

 

For now, your next step is to to see what the custody outcome will be. The immigration issues can be accomplished albeit will take a lot of time and effort.

sorry  for your denial but it is pretty hard to believe that a 3rd party could call any embassy

even when we all try to call to ask questions or get answers  , we (USC)  can not get thru

even out emails fall on deaf ears

It is hard to believe a spiteful ex calling Immigration would result in a denial, unless he was able to provide very compelling evidence, but that is also hard to believe because from what you say, your fiance never got any immigration benefits through him.

 

There is a bigger a chance that a) the documents you provided were not sufficient for the CO to approve your visa b) there are facts in your fiance's immigration past that were not properly disclosed.

 

Please keep us posted when you get more info about the reason for denial.

Impossible to know if they ever considered anything he said, at least without a letter from the consulate saying so or a FOIA request resulting in some sort of document saying so. Both of those seem unlikely. So it is speculation and appears that it would remain that way.

There are lots of spiteful exes out there, so it's not like they just take somebody's word as proof. Normally they would either do an investigation or look for some substantiating factor.

The history of this case is pretty extensive. I would not suggest pointing fingers at one person as being the cause of the denial.

 

He would need to:

1) Know you are engaged to somebody.

2) Know they are going through the immigration process.

3) Know what consulate to contact.

4) Know enough about the case to make a report. The phone support at most consulates is normally only for basic services.

5) Have enough information to make the report believable.

 

Not impossible by any means, but that is a good chunk of information needed + effort required for an ex.

 

Either way, best thing for now is to wait for an actual refusal letter. If the petition is sent back to USCIS, then it will sit to die. At that point, focus on the relationship, gathering more evidence of a bona fide relationship, then proceeding. A spousal visa is suggested, especially given the complicated past, because a refused spousal visa can have the petition reaffirmed if they send it back again.
