Work from home

Hi guys!

 

I am currently waiting for my visa interview for Permanent Residency (K1 Visa).  Is it ok if I work from home here in Texas? which is obviously a US Company.  I passed all the exams, however they want to set up an interview via skype, I am just wondering if it is legal.  Any advise will be of great help.  Thank you

Do you have authorization to work? If yes, go ahead and start working. If not, wait/ file for it before starting.

You can't work until you have a Green Card or EAD.

 

Feel free to take all the tests and interviews you want tho.

@p-ananope, I do not have the authorization yet.  Just had my biometrics last July 26, and no interview yet, last updated via case status was July 30, and it has been a few weeks now.  I just want to work while staying at home to help my husband somehow in our finances.  I sent an email to the employer and I guess I need to wait for the reply.  Thanks!

I get that, but aslo realize the inability to work for several months is baked into the K-1 process.

You cannot work without authorization. It doesn't matter if it's on site or at home, for a separate company or self-employment.

It doesn't matter if it is from home.   It is not allowed until you EAD is done.  It is a downside, along with no international travel, that is part of the K1 process.

But this one of the drawbacks of the K-1. We see this here every day - people finding themselves stretched financially because they chose the K-1 instead of marrying first and filing a CR-1. You surely knew you would be without an income for many months. Why people still find the K-1 an attractive option when they are in your financial situation is beyond me.

Regardless of what the employer says, it is not worth working without authorization.  It could jeopardize your future in the US.

@JFH I understand that, however K1 is the fastest, that is why my husband and I opted to apply for that.  I am just looking for options to be productive enough.  Anyway, thanks for the input.

Volunteering is a good way to help out. Soup kitchens, reading to kids, helping at a senior home, etc. are good ways to pass the time, help people out, etc.

Note this does not cover unpaid internships or similar.

I worked from home for a US based company in a corporate position for 3 years, right after I came here, I resigned. The best thing you can do is to wait for your EAD, some are requesting expedites based on financial loss and such ( only if you want to be back and forth with USCIS) .  It's not permitted even if it's a work from home position. 

 

Try to volunteer, hit the gym, take online courses, Udemy has lots of courses everyone can take.  I have a job offer from a luxury watch store and I have until October to submit all my documents. I can't wait to get my EAD approved.  But the best remedy is to be patient.  🤞🏼 🤞🏼🤞🏼🤞🏼

You cannot legally work without an EAD or GC.

 

You can interview as long as you want. If they make you a written job offer and they are willing to wait for you a few months you can try to expedite your EAD with the job offer and financial loss. Just make sure you don't burn bridges while doing interviews because once you get an EAD and they see you apply again they might ignore you since you already went thru the interview and didn't/couldn't accept the offer. That is something you need to take into consideration. Surprised they didn't ask you if you are authorized to work in the US before interviewing you.
