Just to clarify for the OP....you became a step-dad the moment you married the child's mother.  Of course, that doesn't automatically mean the biological father no longer than any rights to the child (or that you have more rights than him due to marrying the mother).

So you brought them over here on a tourist visa with the intent for them to stay and remain in the US. (Which is actually visa fraud)

 

You don't have the prober documents for the child to stay as you don't have a letter saying that he can migrate and stay in the US to live but only to visit.

 

You are saying you are not a step dad to a child whos mother you just married.

 

Seems like a big mess. You really should have thought this more through before you guys did this.

 

Get the mom to contact the father for a letter that states that she has his consent to migrate to the USA with the child.

A letter to migrate prepared before she left and entered on a tourist visa is as good as a confession to visa fraud.

So what makes you think the letter from the father was obtained to travel and migrate to US and they (mom and son) did not travel elsewhere as tourists?

Where exactly did you read that they were brought over on a tourist visa with intent to stay? Nowhere? Didn't think so either

You also said earlier that the dad was aware they would be remaining in the US when giving the child consent to travel on a tourist visa?

A notarized letter from the father for consent for the child to immigrate should be a good start, at the very least.  Do the parents share joint custody?

So she intended to stay?

 

What did she tell CBP when she arrived as to the reason for her travel?

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Oath: March 22, 2021 COVID-style same-day oath

Regardless if she may or may not need a letter from the biological father, the child needs an I-130 to adjust status.
