Husband wants to file married in income tax but I am in PH. What should we do?

Hello everyone, this is my first time posting on visajourney and this is something I haven't encountered on this site so I don't know what to do. My husband wants to file married on Income Tax Return but I need to have SSN number which I don't have yet because we are not yet approved with I-130. Is there anything else we can do so he can add me? Thank you so much!

He can file As Married Filing Separately, your SSN isn’t required.

Spouse:

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

Exactly, but to do so, he must file on paper, not electronically.

He can file "Married Filing Separately".......He should write "NRA" in the field for your SSN.  He must then mail the return to the IRS.  He can not E-file.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

He can also file Married Filing Jointly is he includes a signed W7 and your proof of citizenship.  That will get you an Individual Tax ID Number (ITIN).  That is what I did with my wife who is still in the Philippines.  I did need her original passport to be submitted with the W7 and my 1040.  It had to be mailed to the ITIN Operations Group in Austin, Texas.

PHILIPPINES ONLY!!!  CFO (Commission on Filipinos Overseas) INFO - Can't leave home without it!

 

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

My example is the same as John&Rose.  I (US citizen) filled in my 1040 as "Married Filing Jointly" on paper. When my husband (beneficiary who lives in France) came to visit me, we went to the IRS office together. There we submitted 1040, W-7 (filled in by husband) and his French passport for the IRS officer review. After the review the officer returned the passport, and said that our tax documents are filed, and that we have to wait for the letter in the mail with ITIN number within 6-11 weeks.

I plan to use the ITIN to claim my husband as beneficiary on my employer's health insurance. Also my bank wants this information for the joint account.

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
