N-400 Denied (anyone who intends to file the day they become eligible, read this)

Agreed. 

 

The first person I found, who posted earlier on this thread, filed later in the day, but still had a -1 priority date. Perhaps they get them from the back of a cereal box.

You have every right to be angry and vent your frustrations. You did not do anything wrong that would disqualify you from obtaining your naturalization. I'm cringing here reading how callous people can get in this forum. You realize whether you file 1, 2,10, 15 or 30 days within the 90 days window, you're STILL considered an early filer. So i don't see why the OP should be penalized or criticized for filing on a specific time within the date of eligibility. THERE IS NO RULE, ABSOLUTELY NO RULE on the USCIS website that states the time/timezone within the 90 days. 

It is clearly an error on their part and i hope Hypnos comes out victorious and perhaps trigger some change. He should not be made to pay the penalties of uscis error.

Exactly...hence the ambiguity on whether it was considered 90 or 91 days.

Well given the two people I've found that were approved, I'd say that definitively answers the question of whether it is considered within the 90 days or not - particularly the person who filed at 12:10am.

 

USCIS cannot deny me and approve them under identical circumstances. That would be unlawful.

Not disagreeing with the eventual outcome...just trying to figure out the likely underlying cause for being in the situation in the first place.

Their first day of eligibility was 4/2/18. They filed shortly after midnight on 4/2/18, and their priority date was set as 4/1/18, with the received date as 4/2/18. They had their interview at San Jose in December and were approved and are now a US citizen.

 

I really hope VJ emails them when I message them here, and that they're still checking that email account. It seems clear that USCIS erred when denying my application.

Or you will alert USCIS that they overlooked that aspect of that person's application and will then deny them as well.

Oh man I"m so glad I saw this topic!  I had read somewhere else that people were filing the N400 along with the removal of conditions form because it was taking about a year to do that one and that they would most likely be approved together.  I was getting ready to mail it Friday!  Yikes!

 

Hope you get this straightened out soon.  I'm so sorry you've had such a hard time.

I did receive a response to the SR I submitted through my online account last night. In my request I said how I believed they had made an error and requested they reconsider. 

 

Their response was simply a boilerplate canned reply stating that I could file a formal N-336 to appeal their decision if I believed it to be a mistake. That's basically what I was expecting.

 

So, that's that. 

 

A local DFW TV station also contacted me today saying they wanted to interview me for the news. After speaking with the lady at the congressman's office, I've decided to hold fire on that for right now. I think hitting the nuclear option like that might be ill-advised when my congressman is still working on it. I told the reporter that if nothing had changed in two weeks then I was happy to then sit down for an interview to publicise all of this.

I got my interview notice today but I don't have  priority date listed on the top of the form, it is just blank

Did you have a priority date listed there or nothing?

No, my priority date was blank on my interview notice. That seems to be the case for everyone's N-400 interview notices.
