Timeline

Thanks everyone for the input I appreciate it. The plan was to file ASAP but I have a family member who is going to be a joint sponser and we don't live in close vicinity. She is not very computer savvy so in the unfortunate event she doesn't complete the Affidavit on time we might be late which I wanted to avoid.

So for my affidavit of support, do I need to have another formal letter from my employer or are several pay stubs enough?? Asking them again seems a little obnoxious but for my husband I'll do anything haha. And luckily my hubby has an international drivers license that doesn't expire anytime soon.

Foreign driver’s licenses are only valid for 30 days here in Washington as well.

 

Last thing you want is for your husband to receive a ticket while driving on an invalid foreign license while out of status.

Yep.  States are strict on who can legally drive...in Texas, it's 90 days.......My wife was fortunate that Taiwan has agreement with Texas which allowed her to just exchange her Taiwanese license with a Texas license (no testing).  

 

 

and I would think that driving without a valid license would nullify any insurance coverage.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

No such as an International Drivers License, there is a permit but that is basically a translation for those not in English. I assumed S African ones would be in English?

My husband did have to take both the written and road tests here in Washington state, but fortunately was able to do that within 6 weeks of POE.

Interesting, yeah I guess I assumed because while he was over here on a visitor visa he got pulled over and the police officer told him he was fine since he had his original SA license and International Driving Permit. What I’m gathering is that’s all well and good on the visitor visa but not a K-1? He’s not an OR resident yet. I want to get this dialed in.

Correct.  He is considered as a non-visitor ( he is considered a resident) because he has taken steps to live there....

My husband was also allowed to drive while here in WA on his B-2, using a NZ license.  The point is that when someone relocates from a foreign country, they need to obtain a valid license within 30 days.

 

When you say he's not a resident of Oregon yet, do you mean he hasn't arrived there yet?

He has arrived and we are married. I was under the impression he isn't a true resident until he recieves the green card and we are actually approved..

So can we apply for an SSN even though the AOS is in transition? This is pretty confusing. Can you get a OR license without an SSN??

Not true at all.  The GC process is federal, and state residency can be established in other ways.  All Alec needed at the DMV to prove residency was a copy of something *official* with his name and our mailing address.  In our case, we used our power bill.  I had him added to the bills for that reason.   Your state's DOL website should list exactly what he will need to show when applying for a DL.

A green card would be evidence of permanent residency as an immigration status. Immigration status does not dictate residency for other purposes, both by state and local rules as well as federally (i.e. the IRS definition of a resident can include people that never had any status).

Nor is permanent residency necessary in most cases.

 

You can apply for an SSN within the first 6 days of entry on a K-1 (90 days - 14 days of legal status required). Or you can do so with an EAD or green card.

Not sure on OR requirements for a license...some states may require an SSN and others may not.

But yes, it's a bad position to be in and should be avoided. Waiting to try to skip ROC is foolish.

i agree about getting drivers license without status..in my states I tried to apply for ssn before i got married i wasnt able to get one but they gave me a blue letter that i need if i want to apply for driver license but i lost it and dont want to go back to social security and wait for 3 hrs to get it..

 

this k1 whole process is sucks but applicants should already aware of this circumtances before deciding to chose this type of visa.

I'm not sure about the specific requirements to obtain an Oregon driver's license, but I'm sure you can find it on the state DOL site.

We took the advice of the wise folks of VisaJourney, and my husband applied for his SSN right after POE and before our wedding.  I think it was the day after he arrived, actually.  It did take a month to receive it, but he's got it now.
