Hello All, 

 

I filed in a removal of condition form i751 on December 2016 as my conditional green card would expire in February, I moved and sent in the form AR11 which the uscis confirmed to have received and updated it on my file then and didn’t get anything from the uscis until November 4th when a letter came in that the case was denied and terminated cos me and my spouse never showed up for the interview so now I’m been placed on removal proceedings because of this. 

 

The truth is we never received no letter from the uscis telling us we had interview for that date and we were always calling to find out what the status of our case was and all the time the officers would tell us the case is pending and We even went to get an extension cos the previous extension had expired and while we were at the local uscis office they never made mention of such to me or my wife. 

 

So so now I’m confused and don’t know how to go about this whole thing or what to do. Please I need advice and help on what to do. Thanks to everyone in advance.

Hire a lawyer immediately and get a consultation. Why didn't you follow your own case status.

So you received this letter on Nov 4th...and you are only seeking advice now, a month later?

 

 

 

File a new I-751. 

Immediately.  Don't worry about sending evidence, just get it filed with a (brief!) cover letter.

Yes, you will have to pay again, and do biometrics again.

 

It puts you immediately back into non-ambiguous legal status, and you then can obtain a passport stamp as proof of status, including for travel purposes.

 

 

 

Also, if it is now three years since gaining permanent residence and you are still living in marital union (or five if no longer living in marital union), this issue does not prevent you from filing an N-400.

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

 I-751 Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

Thanks All... The reason why didn't take any action till now was because i made an infopass appointment which was today and with all the explanation and evidence that i provide they told me they can't do anything about it as this case has been closed and terminated as it is a whole lot of stress and headache for them to reschedule and start over again. they showed me a copy of the interview letter but it never came to my address and we never got no notice so i just got put on a spot but i did speak to a lawyer and we are following a new route to the case and hopefully everything goes fine.

 

I did like to hear any more advice and ideas that anyone has to give cos no idea is a waste and who knows it could be the breaking point.

Ok, fair enough. As predicted, they won't do anything.

 

Filing an I-290b will be a waste of money, has an unknown timeline, does not address your immediate pressing issue, and is a similar fee to a fresh I-751. You would ultimately end up filing a fresh I-751 after the I-290b is denied (which in all likelihood it will be) so my advice above stands - file a fresh I-751 immediately.

Thanks for your advice, I appreciate your concern and everyone here that has been helpful. My attorney and i are thinking of filling for my citizenship and the i751 immediately since i have been married for 5 years plus as this will help hasten the decision on the i751 even though i have been placed on removal proceedings. What do you think?

You need to get a new i-751 out to them ASAP.

Your attorney is correct.

Same situation I am in - denial letter but no NTA issued, filed a fresh I-751within a couple of days, and then filed the N-400 online the day I was eligible,

Have obtained two stamps since refiling, and also travelled without issue.

Hey @mindthegap 

 

Thanks for the briefing. Mine is almost a month now that I received the letter but as planned we’re filing both the i751 and the N400 together and I also have a stamp on my passport which expires next year October. 

 

My question is is can I travel out of the country with the stamp on my passport and the current situation I’m in without having any issues at the border when coming back in? I wanna know cos I already purchase a ticket to travel out of the country before finding out all these.
