You can file while separated, however you MUST disclose in your ROC submission that you are separated/going through a divorce yet still legally married.  If you don't let USCIS know that you are indeed separated while filing a joint ROC, then you are misrepresenting yourself---and if/when they find out this info later you are down a very tricky road since the initial approval would have been given without the IO aware of all of the facts.

 

You will get an interview after disclosing to USCIS that you two are separated....and to be honest, I would suggest filing with the divorce waiver instead of choosing to submit the petition jointly. 

 

She may be in a good mood now and saying she'll be supportive----but things happen, life happens, people's moods change depending on what's going on at the moment----a year or so down the road when it's time for the interview she might very well end up tanking it completely on purpose because you two are arguing over the separation/divorce/etc. and she just feels like being vindictive in the moment (Note:  if she doesn't show up for the interview, you can switch to the divorce waiver then....but say she DOES show up, and then says something completely detrimental about your case then you're up a creek with no paddle...it's happened before, so be warned.)

It’s water under the bridge now but your story (and many others that go through similar things) shoes the importance of really getting to know someone before marriage. Either she’s a very good actress or you didn’t really know her beforehand. Depression to the extent that it causes a marital breakdown is not easily hidden. 

Please. Infidelity is not a symptom of depression. And you can know someone for 25 years and still find out something you didn't know before or have that person suddenly change up on you. It happens everyday.

Hey man I'm really sorry for u but I'm same spot here i really don't know what to do from where to start but I looked at your post and people had a lot good info just wanna say we need to keep believe in God and just say truth and truth will lead to success inshallah 

About me I couldn't wait I already failed for divorce tow month ago and left

given the fact that i was having all the good intentions to keep this marriage going but she took advantages of my efforts to cheat on me, now i'm really concerned about renewing my green card. I'm really so scared that divorcing her will result in me not getting my 10 years GC. i'm a student currently and i also work to pay the bills while she stays at home. i'm honestly busting my butt since day 1 to make a good living for the family. also, her parents are 100% on my side and said that i should confront her about her cheating and stop paying her rent and bills. but to be honest with you guys, i really don't want to do this and lose my chance to remove my condition. please help

I'm on the same boat with you. Just file for divorce. No need to stay in this relationship. My ex told me similar things like he needed to get his work done and he was too stressed blah blah blah. But in fact he was cheating on me with another girl in a different state! Then he told me he needed more space and it is normal for a couple to live in different houses to have their own space. But in fact the moment I moved out, the other girl from New Hampshire flew to Minnesota to move in with him. Now they are about to get married. His family initially supported me as well. But later they are all on his side.

 

Just have faith in God and hopefully things will work out without your spouse.

Hi again, i know everyone in this forum told me to divorce and move on since i found out my wife cheated, but I’m sorry I didn’t listen because i got in a deep state of depression,I’m currently being treated for depression and seeing a counselor on a daily basis. When my wife cheated we were separate, and as I mentioned before we agreed on going to counseling and fix things now after a month and a half at her parents house i moved back with her last Thursday,but we agreed to stay emotionally neutral until we figure out what we want from each other. I have been working on myself and trying to save my marriage but since i moved back with her i have found out multiple conversations with nude pictures with the same guy she cheated with. I keep on getting worse, i love my wife and i knew her for 5 yrs before marriage,currently I’m 12 pounds under my normal weight with  severe depression. She would send me mixed signals and play with my emotions. I just don’t know what to do. I have a couple of questions tho: first if i want to retrieve the file from the counselor to show proof that we went, what type of file should i ask for? 

2- i think I’m being emotionally abused,because just as of last night she treated me like a husband and today she treated me like I’m some homeless person on a street.should i see an immigrantion attorney?!

i really suffer from staying with her,but part of me still hopes she comes back and part of me is terrified for my fate because I don’t know what to do once i divorce her.

please help

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Ask for a record of your visits, and a copy of your medical file there.
