AOS processing times are based on your local field office. It's impossible to state an average time when some process in a few months while others take a few years.

 

You can find your LFO here by inputting your zip code:

https://www.uscis.gov/about-us/find-uscis-office/field-offices

 

Then you can check the estimated processing times of your LFO by inputting I485 and your LFO here:

https://egov.uscis.gov/processing-times/

 

Cases are approved in a case by case basis too so just because someone in your LFO was approved in 6 months doesnt mean you will too.

Sorry if already asked, how did you guys file your taxes if the foreign spouse doesn't have a SSN yet? I filed mine (married filed jointly) with my spouse's SSN (from her cultural visa which came with a SSN which allowed her to work) but it was rejected by the IRS.

 

I assume we have to file a W-7 (for an ITIN) with the tax return?

Correct, is your assumption. 

Do you know why yours was rejected? The name you must input on your taxes must match the name on her SSN card....just mentioning that in case you used her married name instead and her SSN is still listed as the maiden.

Dunno that much in detail but I haven’t got ssn too so obviously without ssn no job no tax you should wait till ur spouse has ssn new or old  linked to EAD /gc for aos

Ok I see that's what it was, I put her new married name instead of her maiden name. Thank you, this should fix it. Much appreciated.

Literally did the same thing, filled first with my married name and then with my maiden name, both got rejected. I think there's no way to avoid the paper filing. I called de SSN office and they said since my number was connected to the working permit I had on the Q1 visa once the contract was over the SSN gets sort of frozen until connected to a new permit or GC. So even though I have had the SSN before and done taxes on in before it's still going to ring as inactive.

That seems really strange, but the government often does strange things. Were you filing any foreign income or anything?

You can add someone as a dependent (child or spouse with an ITIN if you dont have an SSN. Even without an income, it's financially beneficial to add your foreign spouse and file jointly.

I know, right?? I thought it was going to be no problem since we already had the SSN. No, I have no foreign income and the last time I worked on that SSN was in 2017. Let me know if yours goes through, maybe we did something wrong, but turbotax is pretty self-explanatory.

Luckily we will be applying for an SSN next week with my wife's freshly printed GC so we won't really be in the same situation, but I do hope that you get it figured out. I had read those articles when I didn't know if we would have the SSN in time and was dreading the whole thing.

Congrats on the GC!!! Thanks, I think we might just wait for either the GC or the EAD as well. I have buried my nose in all tax forums and I just don't want to do more printing and forms for now.

I've been quiet since the K1 forum.  Life got busy!  We had our AOS interview yesterday, almost exactly 3 months from application date.   Our case went through the Yakima, WA field office which does have one of the shortest times, especially compared to Seattle which is one of the longest!  If i hadn't changed jobs this summer we would have been in that Seattle queue.  At first I thought it was extra fast, even for Yakima, but it looks like others are having similar experiences too.

 

We were in the office with the agent maybe 20 minutes.  He didn't formally tell us approved or denied, but he dropped a number of hints about being approved.  I think he was doing that customer service/government thing were you never promise anything at 100%, just in case.  He told us we'd either get a GC or an explanation letter in 2-3 weeks, but "most likely a GC."  We did get the case update to "card ordered" within a couple of hours though.  

 

I'm happy to hear that SSA is operating normally.  I was worried since SSNs are free and some write ups suggested that new SSN applications were delayed since SSA was focusing on issuing checks and such.  We just used the apply for new SSN part of the EAD form, but we'll have GC in hand more than a month before the EAD suggested timeline.  Not only is my wife eager to work, being able to file taxes jointly is the difference between a decent tax refund and having to pay :)

Let me/us know how it goes with you when you guys go to SSA next week..i also plan to go to SSA next week on friday.
