Lost AOS package

My attorney mailed my AOS package a month ago and I didn't hear from USCIS. No receipt, or RFE. My attorney swears they mailed it. I called immigration yesterday and were able to talk to tier 2 officer. He check the system and has no record of my documents. He searched under name, maiden name, ss#, DOB- nothing! Would the office hold the package just like that?

I called my attorney back and they keep telling me to relax,that everything is ok but won't give me the specific date when the docs were sent  or tracking number. They just keeps saying that it is normal and that people usually wait over a month to get a NOA. I am under the impression that they might be lying to me or the immigration office lost my package. I really don't know what should I do? I paid for everything up front and I am afraid I might have to sent the package again and pay again.

It usually takes about 2 weeks to receive noa1. I'd wait maybe one more week to be sure, and then it's probably attorney who never send it.

It's been a month already. When I talk to the law office, they are so nonchalant about the whole situation and act like I'm some kind of inpatient psycho. I'm pretty sure if I ask them to resend a whole package, they would expect me to pay for it.

30 days is not unheard of for anything to happen to the AOS packet; but generally is about 2 weeks.  Having a tracking number or signature required would have been more useful from your lawyer though. That's how we knew the lockbox did receive it.

I paid my attorney together with his fees and he was the one mailing his check to the USCIS. That how he told me to do it so now I have no way of checking.

Oh no... This is not the first time i saw people using attorney got problem with the packet.

Did you ask your attorney to see if they have a tracking record for the mailing of the packet?

I agree with Roel, check the payment you use (credit card/money order/check) to see if they already cashed yet or not.

Did he provide a tracking number for the packet? No way any real attorney didn't send it with a tracking number...

They told me they used the tracking, however for some reason they wont give it to me or they date when it was mailed.

I'm afraid they haven't send it yet but at the same time wondering why they would hold my papers since we have such an easy case.

Just tell them "hey, if  I don't see that tracking number I will stop doing business with you". You don't even need an attorney. You're just shelling out way more money then you need to shell out. Putting together an AOS package and sit and wait is not that hard, nothing you need a lawyer for unless you have a super complicated case.

That's kinda BS that they won't give you the tracking... you are the one hire them....

If they insist your package arrived USCIS, ask them just to show you a screen capture of the package been delivered? 

and do you have any receipt that you paid them etc. etc.?

Agreed. Red flags right from the start...using their own payment, not providing a tracking number, etc. Either they're legit and dropped the ball big time and didn't send it when they say they did, or they're a scam. There's zero reason for an attorney not to provide a tracking number upon request. That's really sketchy.

Yes, I have an official receipt I paid them. I think I will go the the office tomorrow, with my husband,  and will have a nice talk with the whole staff.

 

I wouldn't be pushy if they were honest with us. I think they took too many clients and cannot keep up with workload.

It is an law office that was in business for years. Somebody actually recommend them to me.  They were very happy with the service and the price was reasonable.
