CR-1 Question : Request of Marriage License? What does this mean?

Hi All! 

 

This is my first time posting so, please forgive me if I’m not doing this properly! 

 

My husband and I filed for our marriage visa (Form l-130) on June 27th, 2017.  A couple weeks later in July 2017, we received confirmation that our case had been received. NOW, about a week ago, we received an email from our attorney requesting our marriage license. This has been the first time in 9 months that we’ve heard anything regarding the visa. It’s encouraging to know there’s been at least SOME progression ( I think) - we see this as a good sign. 

 

I’m probably just getting my hopes up but, I was wondering if any of you had any similar experiences to this, while going through the marriage visa process? Could this mean that we may hear something soon? 

 

What was your process like?

This may actually be not good news for you... because when the USCIS request something, is usually missing vital documentation, but on the same token, is really hard to believe that your lawyer would fail sending  your wedding certificate along with the package as is almost the central piece of the CR1 Petition.

 

If this the case, you need to fired your lawyer.

Interesting. Does it mean anything if the attourney requested a ‘long form’ marriage license, specifically from Registrar General Office in Canada? 

 

Could the USCIS be requesting evidence to verify info on the USA end of things? 

 

Sorry for all all the questions, it’s just hard for me to swallow that we’ve been waiting all this time, and we may have just encountered a big setback.

your Lawyer should of inform you as to the reason, your marriage license is needed. If the USCIS is requesting now it is for an RFE  request for evidence.

yes that is the  marriage license that should of been sent to the USICS. when I file for my wife I sent in the local  registrar one and got an RFE they wanted one from the national registrar in the Philippines

Ok, I see. I’m assuming the copy of our marriage license that we sent must not have been what they were looking for, and now they want the original? Uh, that’s frustrating. We’ve basically sent the same thing twice.

It still could be good. USCIS could be getting close to approving you and just need the  long form marriage certificate. A RFE for something simple as that should not take that long for them to received. After I sent  in the correct  one for my wife  petition. It was approved about 3 weeks later. I know it seem like a long wait but I do think you are getting close for approval

Your responses are very reassuring. I was almost in tears to be quite honest. Especially since I thought the request was a step in the right direction. Luckily, we received our marriage license in the mail very quickly, and it has been sent off to where it needs to go. 

 

I sure hope we’re at the top of the pile!

explains the different forms..there are 3, and then gives Canadian state specific instructions about which one to get

your petition will still be where it was. It just been set t aside  It won't go back to the bottom of the pile. As soon as they get the marriage certificate they will review your petition and you should be approve

I can't speak for the CR1 but for AOS from K1 we were required an original certified copy of our marriage license, not a copy. I would assume the CR1 would also not accept copies of the marriage license as proof. 

 

I actually requested 3 or 4 certified copies after marriage for immigration and anything else that might come up.
