What are my options to get a visa to visit my mother (us citizen)?

You lied about your overstay and tried to get in and here you are lying that you will "jailed away from US for 8 yrs because you said you were visiting your mum".

No more lies..It will make things more than difficult than they should be for you.

Overstaying is your biggest red flag - you didn't get a ban due to wanting to visit mom!  Ensure you relay information clearly - if you say this at your tourist visa interest you will get rejected again straight away for excluding facts

 

apply for a new tourist visa if your ties are strong to home country.  Your ban period is over and hopefully things solid at home for you now.  If not mum's got to visit you...

Isn't a 10 year ban given for overstays of more than 1 year?  Overstaying 6mo-1yr, it's a 3 year ban.  So I don't think we have gotten the truth yet.

So the border agent denied your entry because you said you were visiting your mother?  Doubtful....

How did you get the 10 year ban, really?  How long did you overstay?

Considering your ban and your overstay, and being denied for a tourist visa before---the chances of you getting a tourist visa is most likely 0%, sorry to say.

I believe average processing time for a GC in your situation is about 12 years now.

 

 

During your overstay for 8 months...were you working in the US during that time?  The unpaid traffic tickets and jail time---was that in the US?

you OVERSTAYED for 8  months and wonder why u cant get a visa?

dont even BOTHER applying again! u basically have a lifetime ban uless you can get an immigrant visa.  

 

not mentioning that the first time, you essentially left out the most important detail.

Hello everyone,

Thanks for all the great info you all have provided me here.

Its great to see so much help from everyone in the community.

Im gonna rule out the italian passport option because of what i learned here.

My mom does visit me here in Brazil from time to time but i still want to be able to visit my brother and sister who are also USCs but dont have time to come and visit often.
My brother specially i havent seen in more than 10 years. Im sure you guys understand thats very painfull to me.

Im trying to determine here if I should continue to persue my tourist visa. My hope is that a consul would understand that a mistake I made by overstaying 8 months does not constitute grounds to keep me away from my relatives forever, after all, I did finish my ban time of 10 years.

From what i can understand i need to proove that I have ties to this country - which i have - but  can some one give a definition of ties?

What is considered a tie ?

Maybe with that in mind i can prepare for my interview in such a way that my case can be understood as a misdemeanor not a crime.

Thanks again for everyone's time and helpfull consideration of this matter based on your experiences.

8 month overstay is a 3 year ban.

 

You apply, you complete the application, that information along with your past Immigration Records will determine if you will be issued a visa or not.

Regarding my ban:

I overstayed 8 months but also voluntarly told border agent i worked illegaly in the country. Maybe that's why they baned me for 10 years. I requested my case online throught the RIGHT OF INFORMATION ACT.

Honestly,  you have to look at this more objectively and stop thinking that the US owes you any sort of allegiance in any way, or that you have any sort of right to enter the country.

 

I'm a legal permanent resident, going through my application to become a citizen---and even still, the US doesn't need to grant me any sort of right to that unless they see fit to do so.

 

Once you stop thinking that the US owes you, or that you have any rights when it comes to entering the country, you can concentrate more on the type of evidence you  need to show them that it is in THEIR best interests to allow you to enter----not YOUR best interest.

Im still confused about what constitutes a tie.

Ties to your home country would be employment, ownership of property, returning home on other visas granted in the past, schooling (if you are not working), active financial ties, that sort of thing.

 

Family /children in the home country they don't really consider because people have been known to leave their kids for years.
