Timeline

I'm an American citizen who filed an I-129F for a K-1 fiance visa for my Dutch fiance on January 30, 2017. Today on May 8, 2017 I received an update from USCIS asking me for additional information. The update did not provide any information about which documents they need. I apparently have to wait for the letter to come in the mail. When I called the 800 number I was told it will take an additional 60 days to process the new documents once they receive them.  Does anyone have experience with this? How long has it taken for other couples? Which kinds of documents could they be requesting? When I submitted my original application I was meticulous about including everything they asked for, and neither of us has a criminal background that would prevent this process from moving forward. I was born in America, fell in love with a guy who lives in the Netherlands and I want to marry him. It's that simple, but I feel I'm being treated as a criminal by the country I was raised to love. I'm following all the rules and my fiance and I have both made so many sacrifices to be together. I'm at a loss for words at how difficult my government is making it for me to get married. I'm reaching out in case anyone has any information that could help.

There's any number of reasons for an RFE. Some are simple mistakes (missed checkboxes), others may require documents to be obtained such as police or divorce records. They may require more evidence of meeting within the past 2 years, or verification that you did not meet through an IMB. You'll just need to wait for the hardcopy RFE to arrive with the details.

 

Edit: And no, it's not like they're treating you like some criminal by having to prove that 1) you are eligible and aren't committing fraud, and 2) you aren't being used for a green card, at risk for being abused, etc. They don't have problem with you being married, but they need to ensure that the person you want to bring over the US is not a risk to you, the general public, or the government.

Hi. Don't get discouraged, an RFE is a small bump in the road to having a forever together with the person that you love and at least you know someone is looking at your file.

 

An RFE can be for many different things from a simple box that wasn't checked to missing information or documentation, it could even be for documentation you sent in but got lost or misplaced in the shuffle that is USCIS and CSC. You really won't know until you get your RFE letter in the mail though. I've seen many times that once you sent in the requested documentation it can take from a week to maybe a month to get approved. Then once you're approved everything from then on should pick up some speed.

K-1 Visa

I'm sorry you got a RFE, but the US government has nothing to do with making it difficult for you to get married....you can get married any time.   However, you are asking for approval for a foreign national to enter the US to live permanently and eventually become a US citizen with all the privileges that go along with that (and the problems, too, of course).  It should be a deliberative process that may have more steps and take more time than people want.  

Lots of couples get RFEs; unfortunately, you will have to wait for the official notice before you will know what they are requesting.  Hopefully, it is something simple that you can submit quickly.  It may or may not take the full 60 days they told you to review what you submit.  This is, however, not a fast process and requires patience.  Hope it moves quickly for you.

Hi there, what you will be receiving is an RFE. Basically nothing really is wrong and while it is annoying they aren't treating you like a criminal. This is a common and standard procedure. There are several possibilities:

 

1) You sent everything in, however they'd like a little more than what you sent or you forgot to include something (yes it happens).

2) You sent everything in, however some donut in the office lost some of it (also very common and happens). No they will never admit to you that they've done anything amiss, so even if you already sent something they might ask for, you may have to resend it again.

 

As for what it is they would like to see, you'll have to wait until you receive the notice. It'll instruct you how to respond and where to send it. Whatever it is, it is usually simple to resolve. Once they receive what you respond with, they will get back to work on your case. If anything this is a good sign that someone is looking at your case, and you'll be finished relatively soon.

hello this my second k1. my ex fiance and me did a k1 on 2013, we got RFE on septenber 2013, he sent the documents required on october and arrived to USCIS on october 16 and our case was approved on  cotober 24, 2013.

i dont know if 3 years later they work fast like on 2013.

I took my oath ceremony in Indianapolis, it was a nice ceremony, where people from 35 coutry become american citizen.

Emotions really won't help you, at all. Give it a week or two (that's a usual time) and you'll see what they want from you. I'm not going to repeat what others said, they laid out all possible reasons why you are, possibly, getting RFE

All of us who have gone before you felt like this too: we're just two people in love who want to start their lives together, why is everything so complicated? And yet, once that stage of things is over and we're finally married, it all seems like it passed in the blink of an eye. Patience is the name of the game with USCIS - we've all been there, we know how it goes, and stressing over it or feeling like your case is different and special won't help you - quite the opposite, it will leave you frustrated and anxious. And your fiance is from a low fraud country, so things will most likely end up being fairly easy, smooth and fast for you once your I-129F is approved. Some countries have it a LOT worse: hard interviews, a need for the USC to be present at the interview otherwise it gets denied, or even very very long Administrative Processing times after the interview, only to end up with a denial.

 

Really, as hard as it may feel right now, relax. You're only just beginning your journey. :)

That happen to me too , so when they requested more evidence I started to watch videos on YouTube on how to prepare the paper work and the second time I sent it , it got approved . This video helped me out a lot .

Our RFE is asking to prove we did not meet via international brokerage site because on the i-129f all we stated was "we met online."  We met via dating website,  We will be sending the terms and conditions of the website along with a simple narrative.  Is there anything else we should include?

RFE's are not the end of the world, most of the time it's the simplest thing. I, for one, got a request for additional evidence in the K-1 stage for a copy of my biographical page of passport and we did not check question 33 in the I-129F form. Breathe.

RFE notice in front, followed by a cover letter, followed by whatever they asked for. The cover letter isn't required, but I think it helps organize the documents.

 

They're really sticklers for the IMB requirements lately. Providing the ToC is good. If you still have access to the first messages sent/received, you can send that as well. I also had the dating website send me an email from their customer service team to verify they are not an IMB.

Thank you very much.  The dating website TOC specifically states it's not an IMB, but I like the idea of a letter from them too!  Not sure if I will have access to the messages because it has been a couple years since we have been on the dating website.
