CANT ATTEND I-485 INTERVIEW (HELP)

Hi guys, we are new to this site and have a question. My husband and I got married in March of 2016 and my husband is from Ireland and I am from the US so we got married while he was on a k1 visa. We have been living together in America since. It is now November 2016 and we are in Ireland visiting his family for the holidays and got a letter in the mail back home for a I-485 interview on December 15th and we won't be in the country. My husband has a work and travel permit and that is how we were able to leave the country. We wont be back in the country until January. Flights back to Boston for a few days in December are upward of $1000 since I will need to attend also. Is there anything we can do? I already contacted our lawyer, but he hasn't been the most reliable person during this whole process. Who can we call? Will they care that we are out of the country visiting family or is that not an excuse to reschedule this interview? We are so gutted that we weren't waived for this interview as it seemed everything else went so smoothly. Please anyone with advice or anything at all, we are desperate.

They will deny his greencard and he may not be allowed back in the country.

Why would you leave such an extended time if you knew the aos appt was pending?

there should be an option the the interview notice to re schedule the interview. if not those flights back are a whole lot cheaper than having to redo the whole visa process.

You can try to see if you can reschedule. But be prepared for emergency return if you can't. Otherwise it is back to square one.

Not meant to scare you, but you have to weigh your options carefully.

If I am in your position, I will cut short of the holiday and come home for the interview.

Also, you never know how long you are going to wait for the reschedule interview date, could cause more anxiety (depend on your character).

We actually just spoke to the lawyer and he was surprised that we were so worried and he said he will write a letter asking for a continuance? He said he has done this a few times before and the only time he has trouble was when someone asked for it multiple times. He asked what day we would be back and said he will include it in the letter and we should have no problems at all.

It has been seen on here time and time again. Denied for no show.

Make sure this attorney is well versed with immigration.

Anyway if you dont go you will get denied. If they dont get your "continuence"....

When he tries to enter if removal has began then he will be shut out.

Your risk. Not worth the headache there will be plenty of holidays in your future.

You are counting on USCIS on being efficient and receiving/processing reschedule interview letter in time amid the holiday season where people are taking time off from work.

Agree'd. And also it's good to note that even if you ask for a reschedule, the actual letter saying yay or nay for the reschedule may come too late for you to make your choices. I'd heavily prepare on being here for the scheduled date.

Exaggerate much? So much drama on visa journey.

OP, reschedule the appointment. It's well within your rights. People have emergencies, get sick or even die before their interviews.

Call and reschedule ASAP and get confirmation that it'll be rescheduled.

And fire that idiot attorney.
