Hello , I am new in the US and I am just trying to figure out how could I get the employment authorization. I have all the documents needed , I am just not sure what to send as an "evidence establishing that you have a residence

abroad that you have no intention of abandoning."

What have you used as a proof of that ?


Also , do I apply for the Employment authorization card or Social security number first?

I went at the social security office and I have been told that I am not eligible for it and I need work authorization first.



Any info it could be very useful!

hi

a tourist visa is for visiting, you can't work on a tourist visa, so no employment authorization and no social security

unless you are married to a USC. then your spouse will file for you, then in a few months you will get your EAD work permit and you can go to the ss office

Yes , this is what I was told at the social security office but B2 visa is for tourism . B1 is business / tourism. I did a good searching before I applied for it!

I am a nanny (so domestic employee) and what I would like is to be paid legally. How could I do that with out a SSN ? Any ideas?

I am staying here for a few months though , but still I want to be legal .

Contrary to what u believe, you cannot work on a B1 visa, and can get deported and a ban from the US if you do work, as it is illegal. There are tourism companies that hire foreign workers, do some research and apply through those companies..

When you applied for your B1 and had your interview, what did you say your purpose for coming to the country was?

You've been told by officials of the SS office and repeatedly on this site that you CAN NOT work on a tourist visa. Any work you do now will be illegal. Why are you trying to find a way around it?The answer is not going to change.

Your visa is for workers of a company who need to enter the US temporarily for meetings, conferences, negotiations and such. It is not for people to come and start working. You are not going to get an SSN or Authorization to Work until you have the correct visa that allows you too.

I applied for a visa during summer 2016 ad a domestic emplployee! I used to work for this these family before , I haven't just came and found them here! I know that this would be illegal!

They told me that I CAN GET work authorisation applying for the EAD card. At the moment, I am not!

My question is what to give them as a proof that I have no intention to stay here permanently and I am going to return to my country.

That's all!

If you don't have any answer, please do not say odd things!

You need to show an apartment contract or that you own a house or something like that. That's the problem with that kind of permit for a B1 as a domestic servant. For most other Visas you just need to show proof of ties to your home country. This one specifically asks for proof of foreign residence. I would also get documents showing that you are still registered at a place in your home country (ask the citizen office in your home country).

You can't get a SSN at this point because the SSN office won't know what to do with you at this point since they see you as a normal B1 visa holder right now.

Just tell people who say that it's illegal what you are doing or it doesn't work or whatever that they should read the instructions for the EAD on the USCIS page or just post a screenshot in here where it explains in the form what you need so they see that it's legit and legal what you are doing. It's just a thought..

Also: Maybe it helps showing residence in your homecountry if you send a copy of a recent bank statement being sent to your home address in your home country or another official letter with a recent date. But they actually want to see an apartment or house contract...

Who told you you can work here under your current status??? The family?

How is this family's word better than the SSN office or the rules that is spell out on the official immigration website that LOTOFDOUBTS quoted out above?

I understand that you are not getting the answer that you want but you have to accept the fact that you will not have authorization to work under a B1. The sooner you accept this and stop trying to find a way around it the sooner you can apply for the appropriate status that allows you to work.

Immigration options that allow you to work...

J1 visa: This allows you to be an au pair (child care) for a year or two in the US.

Work visa: You will have to find a company to hires you then the company applies for the work visa for you. This takes time and is expensive. Also there are different type of work visas. https://travel.state.gov/content/visas/en/employment/temporary.html

Permanent Resident: A qualifying relative (spouse, child over 18, USC fiance, or USC sibling) must petition for you and you must be interviewed and approved for a green card. Once you have a green card you are allowed to work. Again this is a long process.

Student visa with option to work: Most times this requires you to work for the college you are attending. And yet again this is a long process.

Please do your research on this site and the immigration sites or maybe try to consult a competent lawyer.

Read the instructions for the EAD form on the USCIS website. Read page 3 No. 5. I attached a screenshot.

People are giving you the correct answers and you accuse them of saying odd things.

Have your employer help you get an EAD because you refuse to believe anyone else that you do not qualify for an EAD on a B1.

Stop being angry at people trying to help you.
