and you can also try to go on your B1/B2 visa, I know people who did that and if the visa is valid in your passport, they most likely let you in. You could be rejected to renovate or to get the new tourist visa but the valid one works. My son waiting for his Green Card entry had the valid tourist visa and he traveled several times visiting me and even stayed once for almost 6 month. Usually the valid tourist visa works and the immigration case doesn't affect it until it's expired.

yes, we have still one month left for the 90 days. but as I said she is very unhappy and mad at me now. I want to make her sure she is my propriety She is even not ready to talk to me. I am just going to fix what happen not to stay there at all.

Well if she won't even talk to you then that could be a problem, just turning up on her doorstep could turn bad if she tells you to leave and you don't.

You can try to contact the us embassy in your country to have them reactivate the k1 visa, however this is not guaranteed and is a long shot. I only know of a two times this worked and they had to show lots of evidence that it was a dire emergency that they absolutely had to go back for and that there was still an ongoing relationship which it doesn't sound like there is as she isn't talking to you.

What we are saying about the B1 is that even if it looks fine in your passport it should be flagged as cancelled in their systems.

Also please tell me it was an typing error and you did not mean to write that 'I want to make her sure she is my property' coz that would be wrong :-)

You had a family emergency that was serious enough that you had to leave the country, abandoning the K1 visa in the process, and now your girlfriend is mad at you about having to leave? Mad enough not to talk to you during your time of need?

Unless I am missing something here, if I were you I would be reconsidering the relationship altogether. This is hardly the time for a "surprise" visit. Even if you could manage to have the visa re-instated (I have yet to read of it happening here on VJ), you two need to talk.

Need to talk, it's true. Try to reach her. sometimes we don't talk feeling so hurt but if she really loves you, insist and talk, tell her everything is in your heart, tell her, write to her, even she is not answering, she will read and if she loves you, she will forgive you or she will apologize and you will get back together.

Contact the embassy first whether your K-1 can be reinstated because you are able to demonstrate that it was due to circumstances beyond your control. It's really annoys me to hear somebody to suggest refiling without even citing any basis of the law or the administrative rules of the embassy and without even considering the time, money, emotions, and the effort that were spent. Half glass full guys.

you cannot enter again with the K-1, it's a single entry visa and your B2 was cancelled the day you K-1 was issued.


Contact the embassy first whether your K-1 can be reinstated because you are able to demonstrate that it was due to circumstances beyond your control. The B2 B1 visa is still valid and did not cancelled

You won't know whether it actually got cancelled or not until they tell you at the POE. Maybe they didn't stamp it but still regard it as cancelled as soon as they see that you used a K1 before.

Every single case is different so maybe you will even be let into the country but what are you thinking about doing then?! Marry on a B visa and then file for AOS?! While this usually would work there's a great chance in your case that the officer at the POE will ask you questions about your intent to marry and file for AOS. The only way he/she would let you in is if you then swear that you do not have intentions on staying and filing for AOS. Now if you then decide to file for AOS although you told the officer that you won't, USCIS can give you a misrep charge for lying in front of a government official which has a lifetime ban. This would be a way bigger issue then just filing for a new K1 again. I don't know how big the chances are that USCIS would decide to go that route but I've read before that if people do their AOS from a visa, USCIS tends to check the written answers CBP put into your profile how you answered the questions at the POE

Contact your consulate about activating your K1 again. I really hope that works for you. If not, the K1 process tends to be a lot faster after the summer months so it might not take as long to get a second K1 as you anticipate.

Can't find the post anymore but it was just recently. I think it was a girl from a South American country (I think Brazil) who successfully did that.

A tourist visa is valid for travel until the immigration visa is issued. Once an immigration visa have been issued, the tourist visa is cancelled because the person is no longer coming to the US to visit, they're coming to immigrate.

OP, up to you if you want to marry someone who gets mad at you for attending a family emergency, however, you've now abandoned your k-1 visa and will have to either apply for another k-1 or get married and apply for spousal visa.

I am the U.S. citizen. My (now) husband entered the U.S. on a K-1 visa but had to leave for a family emergency before we married. I contacted the consulate in Rio de Janeiro, and they were willing to reissue his K-1 visa as long as he returned to the U.S within the time time allotted by his original I-94. That was 90 days from the date of his original entry. They did not request any proof of the emergency. See the following link.
