Timeline

Just recently a woman came to marry on K1 and posted on here she was not sure of marrying and returned home

She changed her mind again and made an appointment at her embassy and the K1 was reissued

Try that instead of your B1 B2

I am the U.S. citizen. My (now) husband entered the U.S. on a K-1 visa but had to leave for a family emergency before we married. I contacted the consulate in Rio de Janeiro, and they were willing to reissue his K-1 visa as long as he returned to the U.S within the time time allotted by his original I-94. That was 90 days from the date of his original entry. They did not request any proof of the emergency. See the following link.

The wrong assumptions -- stated as fact -- in this thread are embarrassing to read.

The truth is that the K-1 can be revalidated by the consulate if an emergency arises, the beneficiary has to leave, and there is still time within the original 90 days.

However, it's highly advisable to notify the issuing consulate before the beneficiary leaves the U.S., or as soon as possible otherwise, to give the COs there a head's-up.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

If it was an actual emergency I can't see why she would be mad at you. Your other thread just makes it look like you both decided not to get married then you went home.

If in actuality she isn't talking to you then you cannot use the k1 to stay in the us even if you got it revalidated. K1 visa holders can only adjust status to get a green card with those who sponsored them for the k1 visa.

You can try and re validate your K-1, get back to U.S and get married within the remaining limit. Some people say yes, you can do this, some people no.

But,

1) You don't currently have a working relationship. If this is not fixed then forget it.

2) You have to get back through POE and I'm pretty sure they are going to ask you a few extra questions about why you left and returning.

3) Is there realistically enough time to get this done?

4) We are not relationship counselors and we don't know the details. From previous postings you can pretty much get an idea of what most posters are thinking.

Good Luck on this. If you don't get it done then you have to start all over. K-1 or CR-1.

I don't judge. Long distance relationship and all the documents process is not easy for anybody and different people react different. And not only that, we don't know well the real situation of our beloved, specially if they live in a very different and not easy life country. All this immigration process and the communication are not easy at all, sometimes we even can't imagine what the other person is going through or how do they really react. But if there is the real love, they will get back together. I wish you all luck, if you love her, keep trying and if she really loves you, it will work

My K1 visa is already expired but I have a valid B1/B2 visa which I do not want to use it for married. The B1/B2 visa I have is valid still.

Does she need to apply again for me for the second K1 visa ?

Does waiver is reqired for her if she has to apply again for the second K1 VISA?

I am planning on going to surprise my fiance in U.S but I am scared if they denied me to enter the U.S I have a valid B2 B1 visa. The B2 B1 visa I have I got it before I get my K1 visa.

Is there any chance to not let me to enter? this cause a real problem for me to go there in the future?

I agree, it certainly is! And while apparently he can reinstate the visa (I haven't personally seen a case of reinstatement of the K1 visa), using a K1 visa to come here and work on the relationship is expressly not its purpose. If I were the OP I would rethink a relationship where a family emergency is viewed as a personal slight against the fiance. Not a good sign.

Regardless of either story, I think the consensus is his B1 B2 is dead and he is out of luck. With a dead B1 B2 and a dead K-1 if he wasn't able to re-validate, slim or no chance on that maybe, any attempt in the near future to obtain another visa is going to be, well, we know how difficult that will be.
