My Fiancé will be Annuled Sept 20th. Do we still need certificate from NSO?

Ive been to Cavite 8 times to attend all my fiancés hearings. The courthouse in cavite is very small and seldom handle annulment cases. I'm not worrired about the annulment because the judge said this will be my fiances last time going to Cavite since we both travel 14 hours by bus from Santa Maria, Isabela. The annulment isn't my concern. Just wanted to know how does it take for the LCR to send the Decree to the NSO. But now I have some good news so I'm nor worried anymore.

MEETING

12 March 2012: Met Dyn at a coffee shop in Kuwait

Summer 2012: I returned home to the U.S. to prepare a way for Dyn

Fall 2014: Dyn returns home to Philippines after seven years in Kuwait

ANNULMENT

February 2014: Engaged while I visited Philippines

March 2014: Officially hired attorney and filed for Dyn's annulment in Bohol, Philippines

December 2015: Bohol District Court issues decision in our favor

December 2015: Judge sends transcript of his decision to OSG for processing

February 05 2016: OSG returned receipt and approval to district court in Bohol. CoF to be issued end of second week in February

February 09 2016: Dyn is presented with the Entry of Judgment and her Certificate of Finality via the local court.

February 15 2016: LCR issues annotated marriage certificate, and necessary documents are forwarded to the NSO / PSA visa LBC

April 19 2016: Received CENOMAR and Annotated MC from PSA via private courier. DONE! COMPLETE! FINISHED! OFFICIAL!

I-129F / K1 VISA APPLICATION PROCESS

April 04 2016: I-129F sent to Texas Lockbox via USPS Priority Mail

April 12 2016: Email from USCIS acceptance confirmation

April 17 2016: Official NOA1 hard copy received

July 12 2016: NOA2 Approval hard copy received

July 14 2016: Post Decision Activity email from USCIS

THE LONG WAIT (USCIS misplaced approved petition)

September 16 2016: NVC received approved I-129F petition and assigns case number

INTERVIEW / MEDICAL PROCESS

October 04 2016: Day 1 of medical at SLEC in Manila

October 05 2016: Psychiatric evaluation off-site due to psychological incapacity annulment (10 hour eval with 800 question profile test)

October 13 2016: CFO Seminar completed successfully and certificate awarded (CFO stamp not issued until visa is presented).

October 20 2016: Return to SLEC complete psychological evaluation with resident psychologist (less than ten minutes)

October 21 2016: Vaccination day at SLEC (medical finally complete)

October 25 2016: Visa interview at USEM in Manila (APPROVED)

HOMECOMING

November 19 2016: Dyn's arrival at POE Dulles IAD in Washington DC

December 01 2016: Married

I am still baffled as to how the I-129F petition got approved if you stated that she was/is married, and did not provide the annulment decree with the petition. There are only a few requirements for the petition, and one is that both are free to marry at the time of filing. It would seem the adjudicator dropped the ball on this one, and was leaving it up to the consulate to deny and return the petition to the USCIS.

Almost sure it got approved because OP checked that his fiance is/was single.

Had he check divorced, USCIS would've requested proof of an annulment or divorce decree.

It was approved under false pretense or misleading info provided.

This was my initial assumption as well, and why I asked the OP earlier in the thread if he checked that she was single on the I-129F. He never answered.

OP, you're in total denia She was NOT free to marry when the I-129f was filed, her visa will be denied regardless if the annulment goes through. Now you have to also worry about the fact that you lied on the petition because she was not free to marry. Misrepresentation carries a lifetime ban.

Maybe the OP needs to answer the marital status question before anything else and any other advise given. When the I-129F was filed, what was checked on Part 2 (Information about your Alien Fiance) Question 9 (Marital Status)?

Married

Widowed

Single

Divorced

Depending on the OP answer to that question we will know how to respond. The answers have been given in previous threads but going forward if we know the right answer then everyone can be on the same page. If the OP does not answer then the answers will continue to be all over the place.

He would have to mark single to be approved since you cannot be married and file for K-1 fiance(e) visa(though it seems she was/is not currently). I am more interested in whether or not he marked single and that was it, or did he list her previous marriage information in Part 2 #13, and get approved without supplying the annulment or divorce decree. If he never mentioned her previous marriage, then that was false info given(omitted). If he mentioned it but it was approved anyway, then that was oversight on the part of the petition adjudicator.

If he marked single and she was married that is a material misrepresentation and could be alife time ban. He has a lot more to worry about than the date on the annulment papers.

Don't end up like this case above.

Filed for I-129F/K1 visa and get denied for fraud of by the willful misrepresentation of a material facts (She was still legally married at times of K1 visa application).

Done with K1, AOS and ROC

I know how an annulment works. We all know the annulment papers had not gone through yet, which is why I already expressed interest in whether or not he listed her previous marriage on the petition where it asks. They needed to list her previous marriage, and not simply act as if it never happened and she was single all along.

My understanding is she is saying she thought she was never married because she didn't sign the paper. I don't know anything about marriage in the Philippines but I find it hard to believe you could go through all the process and not think you were married. But anyway from what he is saying she is saying is she never knew she was legally married.
