Damn thats sad someone can do this and run...

I'm not sure this is a clear cut case of fraud. Based on the op's original post this could be a convoluted situation where his wife was made to pay off a debt owed by her parents. She may have entered into the marriage with good intention but was then forced into this arrangement.

Yes it is, but I don't want people wasting time and money thinking getting an annulment based on fraud will have standing with USCIS. I don't think they even bother to look at those, given the results people have reported back. I also found a reference once, I think in the handbook, which stated a USCIS agent should not consider a local court ruling and following the standard process.

It's good to know so he doesn't waste more money then he already has :thumbs: really shady situation...

The op was very open about this arrangement to pay off a debt, it was the VJ posters who started the fraud angle.

I have been married to her for about 16 months. She is from Vietnam and I meet her through my neighbor, her cousin. She has had her green card since 11/15. Everything was fine except her parents always want money. I have caught her in a lie a couple of times for instance saying her father was very sick an at the hospital when in fact I just talked to him and he was home. In Feb. see went home to visit her family and wasn't the same, constantly saying she must work for her family. We have been sending a few hundred dollars a month but now she claims the need $1,000. I said I can only send $500 and she agreed. A few days later she disappeared, leaving the attached letter. I have only heard from her buy message, she will not do Facebook messenger or call. Her cousin said his mother was in Vietnam at the same time and someone agreed to give her parents money and my wife agreed to do work for this person to pay it back. She is thought to be around 30 minutes away. The note is what I came home to. O well to large to upload. But i did report her as missing to the police. How should I procede? She only took a few pieces of clothing and he wedding ring which she said she will wear anf left me the engagement ring. Said sorry, Ilove you and I will see you soon.

I know many on here thinks fraud when hearing this but we don't know if she is legitimately in trouble.

The OP only updated that she is not at the salon where she was assumed to be. I hope it is not a situation where she is not locked in a basement somewhere to "work" to pay off the debts. To me that would be worse than abandoning the marriage.

Advice to all: Don't get set up to marry your neighbor's cousin from abroad. That never is good news.

It seems to me that she entered the marriage in the first place to get money. Set up by the cousin/neighbor probably with the aunt/uncles assistance.

Not just marrying someone's cousin from abroad, It applies to all relationship with foreigners. You have to do better home work before getting married.

Yikes, I'm sorry to hear. First, I do hope she's ok. Second... it's lawyer time for you.

Because if you don't the full story (and I doubt you do), this could be fraud or it could be a series of bad luck events for both of you or, honestly, this could be a human trafficking issue. And especially if it's #3.... you don't want to get mixed up in that. You don't want it to seem like you were *in on* the trafficking-- that you provided the visa/GC etc. So, one way or another, you need to get legal advice to get yourself untangled from this situation generally and probably the marriage specifically.

23 Jan 2016: "Blizzard of the Century", wedding canceled/rescheduled (thank goodness we were legally married first or we'd have had a big problem!) :sleepy:

24 Jan 2016: Small "civil ceremony" with friends and family who were snowed in with us. December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. 16 Apr 2016: Filed for AOS and EAD/AP (We delayed a bit-- no big rush, enjoying the USCIS break)

In my original post, it was reported to the local police the next day. They said that there is not much they can do beings there was no sign of forced entry, abuse or other. The officer said that by looking at the note she left, she left on her own will so their hands are tied legally. And we did get along fine prior to her going missing. She was a different person after she returned from her trip, always saying that she must work, her parents need money. Since she has been gone the few messages I got from her was that she is in California doing nails, then she is in Vietnam and doesnt need the green card, family sick and needs money for the doctor (lie, I spoke to her dad the same day at his house) and other excuses. Yes the locks were changed since I have my children at the house and didn't know whom has the key. I haven't heard from her in over a month. I messaged her that I do not care who she is with and it would be in her best interest to give me her address so we can divorce which would allow her to try to remove conditions on her own. She seen it but did not reply.

July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.
