My fiance will be forcibly sent to the army in September, his country has mandatory military service.

If that happens I won't see him for years, he might die since they send them to terrorist-infested areas, and it will ruin our plans either way.

Is this considered an emergency situation to apply for expedited visa processing?

No; getting out of lawful military service is not a reason to expedite.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I've seen members on here post that they had to get a letter of sorts saying they were released from having to do their mandatory time in the military or that they already completed it.

He may need this and being that he's already been picked they may not release him.

Exactly! That's why I was asking.

This is on the mail we get from the embassy:

MILITARY RECORDS: A certified copy of any military record is required, either stating that the military service has been completed, or that the applicant is exempt from serving.

This is a very good answer. You have to think of it this way, if he's already received orders why would the United States expedite to break another country's laws?

My friend's husband, he is from Egypt, just waited almost 5 years for his visa because he never finished mandatory military service and Egypt would not let him leave until his service was done.

Not necessarily. Expedites for have been granted for the foreign fiancé/e experiencing natural disasters (e.g. Philippines) or war (most recently Ukraine) or disease (e.g. Liberia).

However, it is difficult to expedite and if a country has laws that specify mandatory military service, you cannot use a visa to get out of it. Algeria is not considered a state for which expedites are necessary at the moment.

Hello There ...

Just want to tell you Relax !! it is not easy to relax when you start thinking something is ruining your plans!!

anyway the Military service is an obligation for any Algerian Male between the age of 18 to 30. and it is 12 months only ... there is few situation where your fiancé can avoid going like :

1- he is over 30 years old.

2- still a student and can show a certificate that he is enrolled in a university or something.

3- a medical exception .. like he has some health condition that will not allow him to be in the force.

4- family support .. like he is the only one working and supporting the whole familly

all of the above situations would take more then a year to get a paper stating that you are ok to not be in the army.

what i would suggest for your fiancé if he got the call order to join the army to ignore it and never retrieve it or sign that he got it ... live normal keep on your K-1 process and hopefully you get approved for the visa.

he doesn"t need it to leave the country.. none will ask about it in the airport ... but i saw some thread saying that the embassy will ask to show something about the military service situation and if it is the case for the Algerian embassy then i don't think it would make sense to ask them for an expedited process for that while they need to make sure the person has fulfilled his service before issuing the visa.

let us hope some Algerian already been in the interview and can tell us if Algerian embassy would request a Military service to be cleared.

PS : Dear, if on any case your fiancé get stuck and had to be in the army, he is not going to die and they don't send them to terrorist areas ... it is not the 90's anymore the country is safe and peaceful .. my youngest brother after he finished university he couldn't get a job without the military service .. he waited then decided to go after they reduce the period to 12 months ( it was 18 months few years ago) ... my brother got his military paper went to the base and they did not accept him because it was full and no space for him... after 4 months he got another call ... he went stayed for 10 days and when they started transferring them ... he got released because same excuse no more space .. and he got his military paper after 3 months... this is just to let you know if it was not safe men will not go to die ... they go to fullfil the service get rid of the issue and get a job later .. and they spend the whole 12 months without touching a weapon ... just mostly like paperwork and random duties that has nothing to do with their safety!!
