2.6 years AP Denied under section 212 (a) 3 (b)

Im still in shock from yesterday when we got a call thinking they wanted to see us to issue the visa. It all turned out into a nightmare when they gave us the refusal sheet and told us thats all the info they had. I wanted to cry right there i was so shocked. I was furious that my husband could not join me to the USA under information that it totally not true. I cant believe whats happening. They cant just do that to me and ruin our lives and our babies lives. That was a cruel decision based upon information that is a lie. I dont know what else to do it feels as if the whole world turned against us ans i cant take it anymore. All this waiting for nothing.

Whoa, thats a denial on grounds of terrorism-related activity. This seems like a very complicated matter -- have you talked to an immigration attorney? If the information they have is a lie, then you'll need to look into proving that it's not true which an attorney can help you with.

Yes i have contacted 4 attorneys i know and im waiting on them to give me an answer. Everyone who knows my husband or even seen him knows not in a million years he would even think about such things.

WOW! Ok, so what happened, I know you are upset but if you could give us more information we'd love to help you. Why are they making those accusations? Does he have a similar name as someone on a watch list? Was he falsely accused of something in his past?

When he had the interview the consul told him everything went great and all info was ok but then they put him in AP and since then its been 2.6 years. I contacted everyone you can think of i even got it to the president all they said was still AP, and that we should wait. He does have people who hate him in the USA and they once stated that he will never step on the us soil, but idk anymore. I really know he has nothing to do with it. The embassy just told me thats all they had and what they recieved from washington. I dont think they had a mixup with names. Since we began the process its been so hard all the way through from 2012 until now.

Yes im in togo i have been here since 2012 since we got married. Going back and forth between the us and togo

Yeah your right these days its becomming very hard to be granted a visa in lome. Im still waiting on my lawyer to see what else we can do. And thank you ❤️

Find out the issues and resolve the problem

Don't waste the time and money on the appeal / I did one and won it / they validated our marriage but said to reapply

the appeal took almost a year

just resolve the issues in questions, and reapply

That is my thoughts. Even if they did dig something up, in the interests of protecting national security, they probably feel like they don't have to divulge that information.

Your attorney would have to challenge that finding and overcome it.

There are privacy laws the consulate has to follow in regards to disclosing to you what exactly their findings are about him.

Your lawyer will likely file a FOIA to find out the reason. Without knowing what exactly it would be hard to overcome.

The marker 212 (a)3(b) is obviously a very serious matter.
