With a competent attorney it could be resolved by challenging the findings/ determinations and FOIA could reveal a possible false name hit. Not all findings are facts. FOIA (with a good attorney) could be helpful. It's not a DIY matter.

NVC Received : some dinkelsberry yehoo in the house of clingons send our petition to the wrong consulate.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Sorry about your plight, as always I never discourage ppl in the forum

but in this case I say plan to go to Togo to live with him or in a 3rd country

Mexico border (maybe) so you can work in the US

AP for 2 yrs says there is something in his background, how long ago have

you all been together?...they will not reveal all they found its classified & the

long investigation mean they check to make sure that they have the right person.

If its an error DHS will change nothing no time soon & yep his feet wont hit US

soil.

Save your money the attys will just take it & tell you about some other statues

that did not work for him...he cannot even get a D3 visa or humanitarian parole

with this lifetime bar, and Canada will have the same info so there would not be an

option for both of you to try & live there

Its his work that caused the tention between the people in the usa: his work is actually in the usa to africa. The person who took care of his job made him sign a paper not knowing it was to give him full rjght to all the money and cars so my we found out and hired a lawyer and the other guy lost everything. So thats why there was a problem. And about knowing him so well yes i do know him too well if he had something to do with terrorism i would have found out long ago but there is no such thing.

Is it possible that there is a reason behind why people in America don't like him and it has something to do with why you guys got denied? Are you sure you know everything about your husband?

How to obtain a determination that the 212(a)(3)(B) ground of inadmissibility was incorrectly made

No matter which US government agency made the inadmissibility determination, each provides a method to dispute the determination, though each has drastically different processing times. We have achieved successful outcomes by petitioning the US Department of State where the determination was made by the Consulate in as little as 2 weeks. CBP quotes turnaround times of as little as 30 days and USCIS will not offer a time frame. In our experience, the more difficult the situation, the longer it will take to get resolved.

IF the determination was incorrectly made ( false name hit for example) then there is a way to overcome it.
IF it goes deeper than that he won't make it here.
The difference is best to be evaluated by a competent and experienced attorney and not the VJ community and their opinions.
Don't get the cheapest lawyer but get one who has successfully overcome this marker several times before. It is money spend well worth it.
False accusations happen all the time and yes, there is a way to sort through this IF it was indeed a simple false name hit.

Thank you very much and i truly believe they did make a mistake and i hope we can get through this and prove that we are right. I hired a lawyer who is very experienced with the immigration system with 37 years of experience.

I provided a link before and hope you read it and called them for a consultation or whatever lawyer you want to chose.

That's great but has he successfully overcome a false finding of 221(a)3(b) before is what you should ask him.

You can do this line of work for 40 years and still be clueless about how to overcome the specific marker.

So, how is he proceeding with this ? What did he say ?
