Just married, traveling before green card

So me and my fiance are getting married with the K1 visa this summer in the United States.

Her brother is getting married in Canada two weeks later, and we'd like to go.

So we've heard that we can make short trips to Canada after we're married before we get her green card. I've also heard horror stories though of people not being allowed to come back into the United States without their green card.

Can you help me out here?

Since she will not be able to get AP shortly after your wedding, I suggest she enters US after her brothers wedding.

4/12/13 - sent I-485 package

4/15/13 - USCIS Chicago Lockbox received package

4/22/13 - got email and txt

4/29/13 - received NOA in mail

5/08/13 - received biometrics appointment for 5/22

5/09/13 - successful early walk in at Port Chester, NY office

5/22/13 - I-485 updated to Testing & Interview

6/18/13 - EAD went to production

6/21/13 - Card/Document Production for EAD - second email

6/24/13 - EAD mailed

6/26/13 - EAD arrived

7/18/13 - got email about interview

7/20/13 - got hard copy interview letter

08/23/13 - interview - Approved dancin5hr.gif(card production & decision email)

08/28/13 - card production - second email

08/29/13 - card mailed

09/03/13 - card arrived

06/24/2016 - biometrics appointment

11/28/2016 - interview scheduled for January 9th, 2017

Timeline

You can apply for Advance Parole (AP) along with the application to adjust status but it takes about 90 days to receive. The K-1 visa is a one-time use visa. If you leave the US prior to receiving either AP or your green card you won't be coming back until you obtain the CR-1 visa. Maybe you could delay your entry into the US until after your brother's wedding?

You can go..but you'll have to start this immigration jazz all over again! It'll take about a year to get back to the US!

From New York to Nova Scotia, though we'd be flying. My fiance was told this during her interview at the consulate, though neither of us are very law savvy so I'm trying to dig around to find out what this is about.

She has a k1 visa which I know is a one time visa, so I don't understand how this would work.

on what basis can one enter the USA after using a K-1 visa ?

When making a short trip, prior to getting a green card, what doc/visa/hunk o paper allows her back in?

since you heard it, who told you ? I'd like a name and a phone number, so I can get their signature on a 'entry-guarantee' doc, thinking it's a viable doc for you to use during any entry.

If she enters on her K-1 visa, it will be invalidated. If she leaves before/after marrying and receiving Advance Parole/Green Card, she cannot return on that visa; you'll have to apply for a CR-1, if you've married, before she leaves. The short trips you mention would be with either Advance Parole or a Green Card, which you would file for after your marriage. You will not receive either in two weeks. If attending the wedding is important, then you should wait and have her enter on the K-1 after that event.

11/24/2015: Picked up visa/passport and sealed packet from the Consulate! <happy dance>

02/14/2016: Arrived in the U.S. (POE was Bermuda)...CO was really nice!

Alright so it seems there was definitely a communication error between my fiance and the person at the consulate.

It's gonna be rough telling her she can't go to the wedding, but such is life.

there's ONE more option - it's specific to Canadiens holding a K-1 visa - and it's this -

when you cross the border into the USA -

tell the CBP goon that you are NOT utilizing the K-1 visa for this trip; that, instead, you'll be activating it 3 weeks later.

to the best of my knowledge, this doesn't work for k-1 visa holders from other countries, it's specific to Canadiens...

But hey - you've got a bit of time to do more research - please visit again when on a PC, and use the advanced search tool... [not visible on a handphone browser, usually]
