My bad I didn't get my facts from USCIS website which is more accurate, got my information somewhere else. I was not aware the petition can be converted. Permit me to say this, I didn't say,'legal right'. I simply said, "right as a legal wife". What I mean is she can likely be granted a visa if she proves she only wants to attend the funeral and return to her home country.

some errata for you and other gentle readers:

1. tourist visas in the PI are exceptionally hard to get. it's very difficult to show strong ties back to the PI.

2. with an I-130 in play, the immigrant intent is already in play, and by the tourist visa adjudication rules, codified by law, the applicant is firstly deemed to be classified as an intending immigrant until proven otherwise. Many people in other countries easily overcome this initial classification, but because of #1, and because of the fact there's a petition in play to chase an immigrant visa - the intent to immigrate already exists.

3. it might be possible to granted a tourist visa for humanitarian reasons, but it's solely at the discretion of the Vice-Consul interviewing her, and even then, she MUST have a pile o documents to prove-up to the Vice-Consul that she will return to the PI, prove up her ties to the PI, and prove up the humanitarian portion of possibly granting the tourist visa.

Thanks for all who responded

I tried to get another appointment schedule..

Unfortunately I got monday next week which is late

His final rights will be this Saturday and I don't want to delay it any further even if my in laws are willing

I want my husband to lay to rest..

I'm still trying to check if any earlier slots would be available..

Thought it seems unlikely..

It doesn't seem right..

But I believe the reason of my denial wAs because I don't have our NSO copy of birth certificate..

I only have the local city copy..

But the consul just denied me not telling why..

I have letters from his parents, cousin, mortuary and I have certificate of employment

All were never asked and looked at

Also News reports about him

No death certificates yet according to my in laws

It's really unfortunate..

That they don't show any compassion to a grieving person..

I'm not sure yet if I want to pursue the petition, my husband is the only reason I want to go there

Thought I care for my in laws they've been like real parents to me

I don't have any american dream though

I just fell in love

I done't think the embassy will give you emergency visa due to a similar experience my husband was extremeluy sick and should have a surgey he sent me a letter from his doctor explained his health condition and the need of his family with him and I applied for emergency visa and paid all the fees but the visa officer was so rude to me and siad No I can not give you a tourist visa , so do not count on that because they always believe that people will go to the US and never come back

The good news is that you have two years to decide. That is the time limit on when you can file to immigrate to the US based on being a widow/er of a US citizen.

Death is a more urgent circumstance than surgery and health issues

Sorry but you went to US embassy without required documents. How did you expect them to believe on you without documents? You should have death certificate...marriage certificate...letter from funeral house about the arrangement and etc... Your birth certificate has nothing to do with nonimmigrant visa, so I dont know why you are talking about it. Plus, a visitor visa is a nonimmigrant visa...which means you have to prove to them that you will come back to Philippines but in this situation of yours, consulars do and can issue a tourist visa on humantarian ground keeping all the laws and regulations aside...which is why its called humantarian ground...Your late husband's family could try to obtain parole from USCIS too within the US in this situation. You should not worry about the appointment because this is an emergency which means you are allowed to walk-in the US embassy.

There is no need to be rude to the OP, she is grieving... and if you had actually read what she wrote, she DID go with the proper documents and she stated a death certificate has not been issued yet.

Of course everyone has the right to express their opinion and the site thrives on everyone offering what they can to a thread whether its advice, support, words of condolences etc.

This is a thread made by a woman who was recently married and lost her husband whom she clearly loved very much to a horrific accident thousands of miles away and is extremely distraught.

Her world was turned upside down in a split second and we can assume she hasnt been sleeping much or eating and has probably cried more in the last few days then she has in her lifetime.

So to use some softness in your tone is not a lot to ask for. Sure she mixed up some words. I dont blame her. She posted "I dont have our NSO copy of our birth certificate, I only have our local city copy" (um huh? what? a joint birth certificate?) and then the next posting corrected it to marriage certificate.

Give her a break. Shes lucky shes standing upright after all this.

As for walk in services- yes and no. Embassy walk in services, for USCs absolutely. For those looking for visas? No.

All this only show that people who work at consulate usually are heartless, they dont care about people lives.

They dont care about people's pain.

I am sorry for you.

God help you in your pain.
