LPR facing multiple aggravated felony charges

Sadly, most of the MENA countries I have visited have no problem with pedophilia. More common than not they will blame rape victims of the crime and punish them instead of the pedophile. This has been especially noted in specific countries (UAE for example) where victims caught AIDS and then went to jail for being raped.

The problem is that they teach that someone pitching is not gay, and therefore it is not a problem.... (Sorry to put it so politically incorrect, but that is the way the actually teach it.) The same goes for pedophilia, where you need three witnesses to even get a cop to look at it. (When does a pedophile bring three of his buddies to watch?)

This is especially notable for the country of Saudi Arabia, please check out the "Gulf Daily News" in Bahrain for more information on that.

From what I have seen, they will not only celebrate when this animal makes it home, they will probably give him a lavish lifestyle to go with it. Most of the countries look at it as others than Arab are less than human, and use that as an excuse for their behavior. (Look at the filipina raped by three Arabs in Bahrain because as they said "They were bored". They originally gave them less than a week in Jail with time already served. Then they proceeded to try and wash away the sins by paying the girl $120 from the court.) I would routinely hear of the Arabs bragging about their conquests and how they were only trash from x country.

While he may serve his time in a US jail, he will most likely never have a problem once he gets deported.

I didn't think it was that hard to understand. I don't want to speak for dwheels but here's what I took from it.

Whether I like Bill O'Reilly or not, his show is indeed quite popular. If he was informed that this perv was allowed to stay in the country, he would be all over the story. It would have everything he would like. Bad government, immigration, child porn, a poor justice system, etc. He would be ranting on this for a week. No government agency would want the negative publicity that would come from that. Therefore, letting Bill O'Reilly (or any other member of the media) know would be a good tactic.

I have nothing significant to add other than my condolences for that girl and her family. Luckily most children under the age of 12 recover with much less emotional trauma from those types of horrors and grow into functional adults.

My condolences to you and your husband as well for what you've both been through and are going through.

On a personal note, which I normally wouldn't ever post in a forum:

My family and I have been through a very traumatic and abusive situation with my ex husband, about 7 years ago. It got to the point where I had needed medical attention from his abuse and he refused to bring me to the hospital so I stumbled my way 5 miles by foot to the ER. I had been working towards getting my life together enough to leave him for several years (he didn't allow me to get a driver's license, a car, a job, controlled our finances, etc).

After I managed to get the ability to support my children and myself, I left my ex husband. The abuse escalated. Because he could no longer hurt me directly, he hurt the children to get through to me. He abused our son (emotionally & mentally), who is autistic, and molested our daughter (which I was unaware of at the time), among other things. He manipulated the court system to get primary physical custody, and once I proved he lied to the courts they still granted him joint physical custody of them (yes, this really does happen). I battled him in court for nearly 3 years just for the divorce, I knew it was going to take time to gather enough evidence of his abuse to convince the courts he was unfit as a parent. Finally around the 4 year mark, our daughter, the brave beautiful girl that she is, opened up and informed that she was going through the abuse (she was 10 when she told me). We had a discussion of the options (going to the police, etc), and the consequences of that, and she understood that what was happening was wrong and felt she should move forward and report her father. (I probably would've anyways but having her cooperation and giving her some of the power her father took was always good for her) I brought her to the ER and had a doctor examine and question her. He confirmed the abuse, and now my ex husband is currently being charged by the state, and awaiting trial. There is a nearly 13 year old girl who was abused 5 years ago and remembers everything, consistently and concisely from the time that she was cross-examined by the forensic psychologist. I doubt he will be found "not-guilty".

My daughter has some emotional trauma from it, and has some issues, but she improves every day. She has best friends a "boyfriend" (very innocent and adorable), and is a, happy, bright, well adjusted, and well behaved (for a nearly teen) child. I have found love again, and my children adore their step-father who treats us all like royalty.

So there is hope, the child with enough love and support from her mother will be just fine one day.

The victim of his rape was 6 years old. However, he also has other charges for crimes against her and against her older sister. I believe the older sister was 13. However, I think the crimes against the 13 year old involved hidden cameras and subsequent postings of photos of her in the shower and otherwise undressed. The detective said that about 20 hidden cameras were found throughout the house. Sick, sick, sick, sick, sick.

Although no one I know is a victim in this case, I do know the perpetrator. While I have not been in contact with him for well over 4 years now, he lived in my city and was stalking me and my home in the weeks and months before his arrest. I will feel more comfortable once this reaches closure.

File for criminal harassment for stalking you. Get a protective order although if someone wants to hurt you, he or she will do so unless there is divine intervention. No PO or charges will protect you other than giving you some solace.

Take all precautions that you can take to protect yourself and your family. Rest upto God.

First, I must make clear that this inquiry does NOT pertain to my husband nor is my husband in any way related to the person in question.

About a year ago, a person I know was arrested for rape of a minor and child pornography via a sting operation in my city. There are 6 counts against him. He is in the country jail awaiting trial (still...the justice system can be incredibly slow...). The arresting detective contacted me (and many others) within 24 hours of the arrest and he wanted life in prison because the rape victim was 6 years old. But, I know that it isn’t under the detective’s power to do anything but make the arrest and provide the evidence of the video tapes and photos of the rape. He also told me that because the perpetrator is a Legal Permanent Resident and not a citizen, that he would be deported if he was not imprisoned or if he was imprisoned and subsequently released.

I have seen varying opinions on whether or not the deportation is guaranteed should he not receive life in prison. I have read that if the LPR can show that he would be tortured in his home county, he would not be deported. He is from the MENA region, and that possibility would not be out of the question for such crimes... (The perpetrator has pleaded not guilty despite photo and video evidence.)

​Seriously now. Nothing in life is ever a guarantee except death and taxes... But I can understand your confusion. Immigration + the criminal justice system is extremely confusing. Every case is unique so it is possible to read something online and the context is completely correct and accurate. And then the next article is contradicting but it too is completely correct in its context. Throw on top all the legal jargon terms, and yeah, its a lot to make sense of in a highly emotional time.

Your best bet is to stop reading articles and trying to apply what happened in other situations or similar cases. If you want to know the law or statutes. read the actual law or statute.

Here is a link for the ncids manual. It explains most in basic English and all applicable statutes are provided. Google statues or immigration codes you come across in it if you want more specific info on something.

Your basic answer- Its very complicated. Right now there are six pending counts, but you have no idea what the final deposition will be. Some charges hinge on other charges, so if it goes to a jury- a no on one means an automatic no on the underlying charge. He could always accept a plea at any time as well. Charges can fall into multiple categories when applied to the deportation statute. They (immigration) have some discretion about it but also have many rules they need to abide by.

A waiver? Most likely no the way youre presenting it. You can read through the manual but most ways you twist it, its going to be a no. Aggravated felony conviction has no exceptions. For the CMT (crime of moral turpitude)- its one (1) committed with in the five year mark. So thats date committed not date caught or convicted.. Or two convictions at any time. However exception is if it was from a "single scheme" Because you are talking about multiple victims (2 children) it would be hard to argue this is a single scheme but who knows. But like I said its going to be up to immigration to interpret how to apply the convictions to the statutes when they come down.

On a side note- this is going to be a long process. Your initial post expresses frustration at it being a year and no resolution. Honestly, its going to be several years if he continues to fight it. Then he has the right to appeal, and that can take years as well. Once all the appeals are exhausted- then and only then will immigration get involved.

You need to realize a few things. First, the time hes sitting in jail right now awaiting his 'day in court' can count as time served when the sentence comes down. As you said the detective can 'want' any severe punishment he likes- however you can find the actual lawfully allowed punishments online if you google the specific charge. (they are not as long as people think for crimes like rape and child abuse) And then knock off the years hes already served..

Then, it is very true that if you are subject to deportation and in a state prison ICE does know about, they know when you are set to be released and will pick you up directly from jail and bring you to immigration to see the judge. Most people are like wheh, immediate deportation. Umm yeah- has anyone gotten anything done immediately on the spot in regards to immigration??

They have a lot of discretion on how things are handled. They can hold him in custody or release him if they believe he will attend all his hearings. Deportation hearings go on for years and then the appeals. So yes you can go directly from jail to a judge who will then release you into the public while they sort out your status/if they are going to deport you. Holding people costs money. Do they think hes going to disappear? Does he have anywhere to go? Is he filing waivers? Is he a danger. (you can bet hes got reports at this time stating he went through the prisons rehab program and is all better)

If for some reason he is eligible for a waiver because of how the charges fell- your opinion of what his hardship is/would be is probably not going to be what is presented. Stating your family is upset so you cant go back- well its a big country buddy. Stating you are now gay or switched religions and the entire country as a whole discriminates, on top of the charges. Well thats different. There are lawyers in the world who specifically fight for prisoners and ex cons- the whole human rights concept that even bad people are people. Someone will take up his sob story and champion for him.

So if you are fearful of the man, which I am assuming you are which is why you have interest in his ultimate ending place. You may be able to get yourself on the list of notifications for when he is set to be released after he completes his sentence. If you are still in the same area you may want to look into getting a restraining order for when he is released. If by that time you have moved to another state or across the state then its not really advised since getting one would give him your new address.

You can not get a P O now. No judge will issue it if he is behind bars. Its illogical to say I want protection from someone in jail. They are in jail, they cant physically harm you. If they are harassing you from inside jail you speak to the warden who will stop communications from them. They will issue the order though immediately prior to his release if you feel you need it for the day he comes out.

For those that say media attention should be called to it. Well... I dont know. I do agree that that would cause things to move and yes public shame and attention/outrage does do wonders. Sunshine is the ultimate disinfectant. But the OP is not the victim- shes not even related to them. Who knows if theyve even spoken (?)

We are talking about a 13yr old and a 6yr old who were assaulted by their step father. Im sure the mother is doing her best to protect them and rebuild their lives. So can you imagine being that young girl and turning on the TV and seeing your home on Fox news- because it is the crime scene. Seeing the pictures he took of you (you are of course blurred out) but there you are, your room, your bathroom, your stuff all around- up on the TV with the anchors all shaking their heads.

Most people want to keep stuff like that as private as possible. So it really is a double edged sword. On one side the media attention can help get justice but it exposes the victim so so much. On the other side the victim can keep their privacy somewhat but a lot of shady things go on. I just dont feel its the OPs place to thrust them into the national spotlight but to each his own

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Hopefully the Prosecutor classify him not just a rapist/molester of a child,

but also a sexual predator & menace to society...If you were being stalked

by him you should talk to the investigator to make sure he gets the max.

Nope he wont get life...neither will he be allowed to stay in the US...ppl have

been deported to Jordan for much less (that's if he's Jordanian) and NO! he

does not qualify for CATS also Jordan is still a US allied country.

Every time he comes up for parole that kid parents & ppl as yourself should

attended & dispute his parole saving another innocent child in the country

he will be deported to....hope he get his in prison.
