I NEED HELP ASAP. The DHS is looking to process me but I am married to a citizen.

He keeps on saying he is legit etc and keeps on listing illegal activities.

Makes you wonder what else he has been up to.

It does amuse me sometimes when almost every visa overstayer/illegal immigrant almost always comes out with the line "I've done nothing wrong since I've been here".

Just being there out of status us doing something wrong!

I overstayed on VWP, I knew it was wrong at the time although I didn't know quite how much it would totally screw up my future!

But every day I was there illegally I knew that I could be picked up and there was no defence for my actions, I was in the wrong. End of!

So many people around the world, especially from countries like mine where immigration and free movement is normal, don't understand how seriously the US takes it's border control!

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process

Yup, not done anything wrong except breaking the conditions of his visa and then overstaying on it, illegally working and earning wages in the US, and tax evasion.

I can't imagine why ICE is interested in him.

Here's hoping for a swift resolution.

November 14th, 2013: She's here!

December 12th, 2013: Picked up marriage license.

December 14th, 2013: Wedding

He should call the ICE agent back and arrange a meeting to explain his position about why he willfully chose to violate his visa.

They're an understanding lot and should sympathize with his situation.

So that's what it feels like when coffee exits your nose, thanks for the laugh!

OP... I have to agree with the advice other VJ Members have given you... I think ICE officers turning up at your door, and then a sudden wedding days later is not going to bode well when you file AOS.

He's been out of status since june 2013. IMO, ICE wants him soonish, he's way past the 180 day overstay limit and now he's going to scurry.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

couldnt afford it so I had to leave school.

I agree Darnell. I can only imagine how terrified OP must feel right now.

Hey....i have been spending time reading people comment on here and people talk Non sense while some make sense......one of my hommies from the Uk got arrested with his home boy. trust me they were both detained actually for theft (petty larceny) at a grocery store, so what happened was when they are booking both of them one gave a FAKE name....so when they ran both of them name only one showed up meanwhile both of them both came on F1 visa...so the ICE was notify about this, after 10days of both serving their time the other guy with a fake name was detained by ICE.......To cut long story short this two guys were out of status take note....but the other guy was released despite being out of status!! so my point here is......you have gotten married that's the biggest step of your story regardless whether its legit or not then that's left for the officers to figure....i really understand how u feel about no money to file and stuff cuz it took me almost 5months to be able to send my package and i couldn't even dream of hiring a lawyer....so you might really be stressed out right now but u really have to clam down like really calm down those guys coming after you were just doing what they are told to do.....TRY as much as u can to send your papers so your case can stay pending....as least get EAD to get your mind off this whole mess....infact if its possible send me your email or number so we can talk about this cuz i have seen a case like yours....i mean we are all here to help.

I completely agree with you Kzielu, I feel his story will serve as a stark warning to others thinking of doing the same or have found themselves in the same position.
