I am currently legally unable to leave the country, and securing a visa for my significant other to visit me will be both costly and time consuming, how do I qualify for a waiver to apply for a K1 visa?

The K1 visa is even more costly and time-consuming than a tourist visa. Waivers for the requirement of meeting in person within the last 2 years are extremely hard to obtain - if you have a valid legal obstacle to leaving the country, showing proof that your SO has applied for, and been denied, tourist visas would help build your case. Without that, it's not going to be an easy argument to say that you couldn't afford to meet in person, therefore you should be granted a waiver.

Why are you legally unable to leave the country? If you are not able to apply for visitor's visa due to those reasons, then how are you able to apply for K-1. The waiver is costly and time consuming, and then the K-1 is costly and time consuming, not to mention AOS, and then ROC.

Please provide more info, so more detailed assistance can be provided.

To even remotely think about any waivers (which are next to impossible to get ) your S.O. MUST have tried and been denied a tourist visa... Not wanting to pay for a tourist visa is NOT an acceptable reason why she does not come to visit you... Don't even THINK about it unless all possibilities of meeting have been exhausted.. You have not yet even tried!

No you do not qualify:

- Your fiance hasn't even tried to apply for a tourist visa yet- maybe after 2-3 failed attempts you could try for a waiver

- How long will you be unable to leave the country? If for example, you are incarcerated, they will expect you to wait until you get free and visit then (unless you are in for life); if they took your passport due to owing past child support, they will expect you to pay it off over the next few years and then visit.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

You don't qualify. By you own words above you could have your fiance visit here to you ( cost and time is not a consideration).

Yes! This is a VERY time consuming and costly process. If these are concerns, then I suggest you disqualify yourself from the process. You would also need to prove that you can sponsor your fiancée. Again, it is a costly and time consuming process. If you are not ready or willing to accept this, then you are not ready.

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

Cost and time issues isn't reason enough to request a waiver. If you're not willing to put in either of them in building and strengthening your relationship, how are you going to prove to US Immigration Services you have a real and genuine relationship?

Cost is not a reason to request a waiver. I think it is stated in the instructions booklet. Waiver is very tough to be granted. I recently requested one for reasons I won't be able to visit the country and she won't be allowed to leave the country (long story). We dated for two years; anyways I petitioned after I learned she was able to leave the country. Immediately after petitioning, I have her travel to a neutral country and eventually we met. Up on my return I got RFE and provided the fact that we met and reiterated the hardship I put in the initial petition... now the case is denied...or so under additional review.. So, what I am implying is that , unless you can provide a solid proof of hardship (No cost and/or time), you won't be able to go through...
