K-1 Visa I-129F Rejected - Need Help!

Hi - I'm new to this entire process.

I filed my for a K-1 Visa back in Feb, 2013.

I complete the two sheet and mailed the form off to the Vermont office and included the payment.

I read the form instructions and it never stated exactly what else needed to be included in the petition filing.

After mailing I called the USCIS and they told me not to worry about including any other information that they would let me know exactly what documents they needed once they start reading my case.

It's been 4 months and a letter arrives from USCIS saying:

"if you disagree with the decision and have additional evidence to show the decision is incorrect you may by filing a I-290B, notice of appeal or motion. Enclosed copy. You may include a brief or written statement to support your appeal. You have 33 days to file from this notice. After that the decision is final.

They never say what documents they need? No checklist.

Has anyone out there been approved and know what they want?

I paid $340 and they can't even send me a list of needed documents.

Call them. Find out exactly why they denied your petition. Usually if you're lacking info they'll send a rfe, but maybe if yours was missing everything...

Call them. Appeal it. See what they want and provide it.

August 19, 2013 - NOA2! (email)

October 10, 2013 - NVC has our case, Vancouver number assigned

***Communications with Vancouver begging to put my case on hold a while due to house not selling!!!***

February 18, 2014 - Packet 3 Submitted

February 20, 2014 - Packet 4!!

May 5, 2014 - Medical

May 7, 2014 - Consulate Interview

May 13, 2014 - K1 visa in hand!!!

July 2, 2014 - POE (Sweetgrass)<p>

July 23, 2014 - apply for EI (mother of god that was confusing...)<p>

August 11, 2014 - finally get hitched!

September 16, 2014 - send off AOS/AP/EAD

Also - look on here. See what you need to include. Your lack of preparation may have lost you the filing fee - but now you'll know. This site is a fabulous resource for what you need to include - and even gives boilerplate versions of some documents (statement of intent to marry etc). And examples of the forms.

August 19, 2013 - NOA2! (email)

October 10, 2013 - NVC has our case, Vancouver number assigned

They denied it for sending in nothing else but the form and the fee. The required documents ARE listed in the I-129F form instructions. There is nothing to appeal. They are not incorrect for denying a petition that had none of the required documentation with it. Do not appeal. I paid the fee and completed the form, nothing els.

Does anyone have a list or know where I can get one as to what they need so I can get approved?

Do I need a lawyer?

I did not include any passports, birth certificates, etc. I have all that suff ready to go.

I just need a complete checklist of what they have to have to be approved.

The instructions are right there on the USCIS website. Make sure you throughly read them when you refile. Here is the link again.

Follow the link that the above poster gave you and prepare the packet with everything that is stated in the guide and you should be fine. But don't bother appealing it will be a waste of time. Refile.

you can see what is needed right here on this website...... plus the uscis website also has all the info that's where I found my info before I found this website...

Its a waste of time to appeal. Appeals take up to 6 months. And USCIS wasn't at fault he was so theres nothing to appeal.

OP as the others have said file again pay again following the instructions to the letter ask questions for K1's and than don't rush but send in your package,

an appeal is a worthless waste of time.. chances are if a refilling is done approval will come before a decision is made on appeal... appeals are generally very hard to win unless it was the fault of the agency

His first $340 is gone because he filed without reading and following the instructions. There is nothing to appeal and you are actually suggesting he throw even more money down the drain.
