none of us know for sure if the woman told him or not...that is what he is telling us...and if it is true that he's been posting about staying here and other things about a green card then i have to wonder what his motives are as well......the point is...IF she didn't tell him then that was very wrong...BUT he is also to blame for having unprotected sex with her before truly knowing her...

As for the rest, I haven't followed this case, so I don't know. If you haven't married her yet, though, you don't have a green card, so I don't think VAWA even applies.

Regardless of the personal motivations on either side... If you are not married, you are required to leave the US within 90 days and are not eligible for VAWA... You have to be married to file. If you are married, Although not telling you is irresponsible, you will have a difficult time proving that this was abuse... I believe that you will be returning to your home country. But please get yourself tested so you do not perpetuate this terrible disease should something have happened. I pray not.

This is actually a hot bed issue right now. In the US and Europe there actually have been people charged with a criminal offense for knowingly transmitting HIV. If the OP is infected then I suppose he could try and press charges against her. I think someone got 25 years for this in the US.

After having read your other post I am very confused.

1. Who was the co-sponser when the K-1 was applied for and/or why can't they they co-sponser you for AOS? You state in your other post that your finace lives on public support.

2. No the time waiting for your visa will not be compensated for in your wait for AOS. It is a different process and is independent of the visa process. You go back in a new line for AOS and have to wait your turn.

3. It is fine for you to live wherever in the US you desire while AOS is pending but you must have a bonafide marriage and that usually means living with your wife.

4. After receiving the AP document you can travel outside the US while waiting for your green card for a period of time (don't remember how long).

As to your current post.

I would advice you and your fiance have a heart to heart talk. Stating you know she has HIV because of certain medicines you found is no conclusive of anything.

You need to be tested. The health department will usually do this.

Things are sounding fishy to me but you may be have come here with the best of intentions to marry and be with this woman but coming on a message board and posting she has HIV without speaking to her is inconsiderate.

If you did come here just for the GC forget it and go back home now.

HIV is of particular concern to persons raised in or having spent significant periods of time in countries in which malaria is endemic. malaria (plasmodium falciparum and plasmodium vivax, as well as a few other variants) is endemic to the indian subcontinent, china, vietman, cambodia, thailand, much of the south-east asian islands, russia and many of the former soviet states, africa, and much of south america.

a history of malarial infection reduces the body's resistance to HIV transmission by up to 85%. transmission of HIV into a person who has been exposed to and experienced a bloom of malaria is much more easily accomplished than into an unexposed person.

traveling into these countries puts Americans at risk, though this may not be advertised. additionally, receiving visitors from these countries (that likely carry malaria and may become a source fo infection) puts America at risk.

i was infected with vivax type malaria when living in china, despite the fact that the CDC website makes no mention of the risk. the truth is that central china, including shanxxii, henan, anhui, and hubei provinces experienced an outbreak of malaria in 1995 which has left 50% of the population exposed and as yet untreated, so capable of becoming a source for transmission.

vivax is only terribly uncomfortable and sometimes fatal in the first few recurrences, and killing mosquitos is expensive, so china decided to let it all slide after treating some of the people in the infested areas between 1995 and 1998. apparently, bang-bang day labourers sleeping in the park adjacent 5 star hotels still carry the disease and can give it to foreigners if the maids refuse to keep the windows shut when they clean the room.

Well folks, we have a looney here. At 1154 AM yesterday morning, I received the rudest PM message from "Leader" that I have ever received from anyone in my entire life.

The same person subsequently changed their user name from "Leader" to "Loneman" along with a change in his profile gender from Male to Female at 1159 AM.

Someone is trying to cover their tracks and re-invent themselves. The previous posts were suspect to say the least. The OP has not given enough background information to allow anyone to make a fair assessment about the particulars of his situation.

I would not be at all surprised if the fiancee/wife, showed him a bottle of multi-vitamins and said that she was HIV positive in simple defiance, She must have learned of his ulterior motive to skip state, file for AOS and VAWA, and head out for a 2 month trip to PAKISTAN, most likely to visit his REAL girlfriend who he intends to bring to the USA the fastest way he can. His previous posts are evidence of general fishing.

No doubt his level of integrity on this forum is commensurate with his interpersonal dealings with all mankind.

No, it is not OK to willfully withhold material information, including past and ongoing medical conditions from a partner, fiancee, spouse or Immigration.

Negative results from blood work due to pre-marital boom boom 1in the old country may not have shown up at the point of the OP's visa medical exam. That information was not provided. I respect the culture of people of other cultures and am aware and respect of cultural traditions in India and elsewhere, who prohibit pre-marital affairs. The point of asking that question may have eluded to the duration of his assumed exposure and the validity of any test he can take today.

Also, her medications and dosages may possibly determine the status and length of her condition. We do not know when she was diagnosed, or the reason for her having the test to begin with.

HIV is a virus, a common cold is a virus. HIV has the propensity to materialize into AIDS, a common cold can accelerate into utter and complete respiratory failure. The health of individual's immune system becomes that concerning factor.

DaKine: What would I do? Get new tests for both parties at a different clinic using a different lab, wait for the results. If this is the love of my life that we are talking about, then there would be no conscionable decision, other than to stand by that person wholeheartedly without further thought.

Love is blind to fraud and scams. Not everyone learns this the first time around, diba?

Not in most states, unless it can be proven to have been malicious and with specific intent to infect somebody. There is a federal law called the Ryan White CARE Act that requires states to make an effort to notify spouses of HIV infected people, but does not require notification of non-married partners. In states that DO have notification laws for non-married partners, the punishment is generally pretty minor. In Indiana, for example, it's a maximum of 180 days in jail and $1000 fine. Some states put the onus on the health care provider to notify the partners of the infected person, and impose no penalty on the infected person for not notifying a partner or providing the name of a partner to their health care provider. Many organizations like the ACLU are fighting to have mandatory notification laws repealed as an invasion of privacy, preferring for voluntary discrete notification by the infected person rather than forcing them to reveal their sexual partners to public health officials.

I wasn't able to find a single case where HIV infection was determined to constitute "spousal abuse". If anyone succeeded with that as a grounds for abuse, then they could do the same if their partner/spouse gave them tuberculosis or even swine flu.

The bottom line is if you're going to have sex with someone you don't know very well then wear a condom, and don't depend on the government to protect you from your own reckless behavior. If you're considering a serious relationship with someone, then both should get tested.
