Reentry on K1

Timeline

Hi,

I will be entering the US on the single entry K1 visa on 19th April and getting married 3 months later.

Unfortunately my fiance and I booked a short closed loop cruise - staring and ending in the US and going to Mexico/Carribean - departing in June, completely forgetting that the K1 is single entry. Thus if I leave the US, I will have trouble re-entering.

Has anyone here been in a similar situation was able to successfuly apply for "Automatic revalidation" - enabling them to re-enter?

My other alternative is to sign the marriage papers as soon as I arrive and apply for "Advanced Parole" whilst waiting for my Adjustment of Status (AOS) but I understand that this process can take up to 3 months which defeats the purpose.

I'd welcome any suggestions based on similar experiences.

Don't think I've heard of this automatic revalidation. Single use is single use.

Planning a cruise was poor planning on your part at this juncture.

November 14th, 2013: She's here!

December 12th, 2013: Picked up marriage license.

December 14th, 2013: Wedding

I can think of quite a few options other that your original plan which make no sense,.

You need to postpone if you can, otherwise cancel the cruise. The K1 is single entry, end of.

Anyway, you probably would not be permitted on the cruise. You MUST have a valid re-entry visa before the cruise line lets you on... They assume a certain responsibility that the passenger they admit is ablemtomre enter the USA legally upon return. If by some reason they let u on, when you reach a USA port, immigration meets seperate with all foreign passport holders to make sure they are eligible to enter... You will be deemed not able to re enter at that point.

You need to postpone the cruise... No ifs ands or butts or you could end up,facing another year of seperation filing a cr1

IF you could use the automatic re-validation after a K-1 entry, it would be for travel to Canada and Mexico only.

And even if you were making a short trip to Canada or Mexico only, I would not risk that CBP would know about this regulation and allow you to re-enter. They would be the ones with the decision to let you back in the US or not.

You will not be able to make it on that cruise within your stated timeline. You need to change your plans.

Also you need to revise your wedding date. 3 months from April 19 will put you outside of your 90 days timeframe. You need to get married within 90 days of entry. Best to be safe and make it well before the 90 days is up.

As far as I can see "Automatic revalidation" only applies to F and J visa's.

A K1 visa is not eligible for this. Also, you need to get married WITHIN 90 days of entering. And then apply for AOS.

You won't be able to do your cruise until after you get AP, so I'd postpone the dates on it.
