Urgent! Was was denied visa in Ghana today

My wife was denied visa in Ghana today. They said they are sending the case to the U.S. how do I stop them and keep my case in Ghana? I need urgent advice. The officer said we did not provide enough evidence. We have two U.S citizens together. Chat records. We own land together. So many more evidence. I need urgent advice.

Contact your U.S. Congressman's office, complete the disclosure paperwork, and ask for them to call the embassy to keep the paperwork there.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

All the evidence that you speak of was that submitted with the petition upfront or brought to the interview? Ghana is not an easy embassy how you met. How long you been together, how often you have been back home to visit has much to say about the bonafides of your relationship.

You cannot keep the file in Ghana. You were likely issued a 221g either stating a denial or asking for evidence. If the file is sent back to the USA then you wait until the USCIS looks at it again and sends it back.

Timeline

Petition will be returned and petitioner will receive a NOID/NOIR letter and then you have a second chance to submit more evidence.

If USCIS finds that your new evidence is sufficient they will send it again to the consulate where the CO will either approve the visa or refuse it

again. Most likely they will approve it at that time. Post again when you receive the NOID/NOIR letter. Sometimes the petitioner does not get a letter

and USCIS sends the petition to the consulate without it with recommendation to approve. Good luck.

July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Having land and two us citzens doesn't suffice a bonafide proof of relationship. Show proof of regular money transfers, old and new pictures you guys took together, and if you make regular trips home you can attached border passings or airtickets. Also, for African Countries were traditional wedding is recognised, show pictures of traditional wedding activities that went on even in your absence, but in the presence of your family. These evidences will never be disputed by any CO

Thank you. How long does it take to get the NOID letter? And I've also heard that they send it to uscis so it can expire, how true is this?

Of course I sent all those things and more. Those are basic evidence that every marriage people send. Your statement really makes no sense. What else makes a marriage more real other than having children? Having children with the one to whom you are married pretty much means you are serious. I sent more than 300 pics and 1,000 pages of Facebook, tango, and whatssapp chats. Plus so many more evidence. In fact, I sent too many stuff.

For some reason they don't seem to care about children. A woman on my bowling team were denied and they had 3 children at the time they were denied.

Maybe they never denied her visa, but requesting some details. If you could share with us what the CO told her in its entirety, then most people in vj forum might figure out what to say. Now, all what we re saying might be basically speculative.

No, a CR/IR will not expire. It is K1's that expire. You should get your NOID letter in a few months, 2-4 or so.

Thank you. You have been very helpful. I'll tell you what happened. My wife took 3 binders full of traditional marriage pics, white wedding pics, pics of us kissing and generally having fun, pics of our families together pics of me playing with our children. In fact, the evidence was too them much. The interviewer was upset that I they did not make me do a DNA test before they approved my children citizenship. My wife said she was visibly upset and was making comments like...I don't know why they didn't make him do DNA, they should have made him do DNA. From there on she did not care about any evidence in front of her. She was totally fixed on the DNA. She then denied my wife and my wife told her "what more do you want, we have given you everything you asked and more." The lady then made a comment like maybe I should do a DNA test. This woman should not be able to get away with this bitterness. So I will do the DNA and send it to them when they request more evidence. But I am praying that someone with sense will review our case and overturn her decision.
