Hi!
I just finished going through the process of proving legal custody of my daughter. I was married to her father and divorced him here in the US. It will help if aside from the DS3053, you get a notarized letter from the dad that he knows and doesn't object to your current custody arrangement and the release of your child's passport and your travel plans and that he supports all your decisions regarding your child. You also need to contact a lawyer from the Philippines to write a letter that states that the law when in comes to custody of an illegitimate child in the Philippines.
We were once denied for the passport of my daughter because I only submitted a few paper works and then the DS3053. It can be a difficult process but it is what it is. I applied again and after 6 months, we now have my daughter's passport. Too much back and forth but don't give up on your paper work and you'll be fine.

Hey Bart,
Finally got the passport today after 6 long months! What helped was I found a decided case wherein the son of the naturalized citizen was in the same predicament as my daughter and I with the father re: proving legal custody but this time it was the son who lodged the appeal to the Supreme Court that he was entitled to derive citizenship.
Anyway, after all is said and done, I realized that I could have done this on my own without the lawyer. The Passport people even refused to speak to my lawyer and I was told lawyers become involved on appeal not during regular processing. So what my lawyer just did was make a letter and his letter confused the people at the passport agency. I had to make another letter.
It's all water under the bridge now, we are happy we got the passport and planning our vacation outside the country soon.

Quick update... we finally got an email back this morning, Friday 3/16, with the attached letter. We had brought the kids' green cards with us when we submitted their applications, but the acceptance agent told us that we could keep the originals as long as we submitted copies. So I'm annoyed that the acceptance guy gave us incorrect information, but somewhat relieved that that seems to be the only issue with our case. We express-mailed the green cards this morning so they should be there Monday morning.

While the 'waiver' in the title Visa Waiver Program may refer to the visa itself being 'waived' for tourist entry, the reason for people believing there is no appeal on the VWP is the following:
When you enter on the VWP you sign the I-94W or the new electronic ESTA version and agree to the following:
WAIVER OF RIGHTS: I hereby waive any rights to review or appeal of a U.S. Customs and Border
Protection officer’s determination as to my admissibility, or to contest, other than on the basis of an
application for asylum, any action in deportation.

This is directly referring to the initial entry to the US - where if the officer at the border says "No entry for you", you have no right to appeal that decision and have to get on a plane and go straight home. (Unless you are claiming asylum)
There have been cases (and I'm sorry I can't quote them here directly) where people AOS'ing from the VWP have not been able to appeal their AOS denial because the authorities have used the waiver of rights to an appeal from the I-94W as grounds for no appeal.
However as someone mentioned above USCIS can use its discretion to reopen the case if they see grounds to do so.
And blankmedia - I'd just like to answer your point about why some people on here get agitated about people AOS'ing from the VWP. It's because to many people it feels like they are jumping the queue - even if it's legal with 'no intent' on entry. And even if intent is so hard to prove that it's a viable option for those with intent.
I still find it hard to imagine how there can be many people who are able to go on holiday for a few weeks, even months etc and then really don't need to go back home to settle up their lives before immigrating. Don't people have houses, leases, pets, jobs, bills, post, commitments to deal with?
Although I also don't really get the 'can't bear to spend another minute apart' scenario either. What about when your partner goes on a business trip or you take the kids home to see their grandparents and your husband can't come too. Do many couples now spend every night of the rest of their lives together?

Bsd, for removal of conditions, they specifically ask for documents spanning the years of your marriage, not just for first and last.

I am frustrated with the constant (posted) stereotypes, male chauvinism, abusive sexism and regular insults...thrown at Filipino women and culture.
IMO and my observation...There are not many men (relatively speaking) that seek and marry a Filipina following "western" relationship equality guidelines (so to speak). "It's a man's world" is the dominate mentality amongst (many but not all) men in Fil-Am relationships. That is (often but not always) why we see posts stating.."my Pinay" or .."my Filipina". (at 46 years old I have never heard an American..man or woman...refer to their spouse as...my American)
I refer to these (most but not all) men as "predators". They go to PI hunting a product.
One VJ poster often refers to Filipino women as "units" (even typing the statement makes my blood pressure rise). Not woman...lady...girl...or even female. Nope...he chooses .."unit". Tell me..is he thinking product or person?
Another will state..."having been married to 3 Filipinas...(get this) I KNOW THEM NOW AND HOW THE FILIPINA THINKS." (I don't think it's a good idea to take advice from a 3 time loser. Common denominator? The 3 time loser.)
Another poster..."believe me...I've been around the Filipina and I know how they can be." (Have I lost something in translation? Isn't this a blatant stereotype comment made by a racist?)
(I can quote many more examples but 3 is good for now.)
My question...what's the motivator? The root or roots of these offenses?
Asian Flu? Yellow Fever? Olongapo? AC? (The lure is cast and the fish bite?)
(is it) "Age doesn't matter in PI...? (I welcome stories about Pinay / Pinoy marriages with large (20+ years) age gaps...any1? any1?)
(could it be) Kano's rejected and burn out with failed "western" relationships having no confidence but the (often very few) Dollars they have in their pocket used to purchase a (better future) wife from a hopelessly impoverished family "gifting" away a breadwinner for a better tomorrow?

If you want to spend a few weeks of vacation every year in Pakistan, that's not a problem. If you plan on living in Pakistan and in the US, your Green Card will not last long. Custom and Border Protection agents have grown increasingly inpatient with being "played" by Green Card holders who abuse their privilege.
The idea of US citizenship is to reward long time permanent residents who lived in the US for years and made the US their home, with citizenship of the country they love so much. It's not a reward for people who use the Green Card as a visitor's visa, hoping to get away with circumventing the system. I can almost promise you that in the computer age we live in, you will need to really reside in the US until filing for naturalization. In the N-400 application, you'll have to list any and all absences from the US since the day you became a resident, to the day. If you have absences of 6 months or more, the Immigration Officer will not be kind to you when you sit in the hot chair asking to become an American, while having lived in Pakistan.
If Pakistan is where your heart is and where you reside, US citizenship may not be what you're looking for.

A resident is a resident.... If you are a resident of the USA and you need no other visa's to come and go. You can attend school. The only issue is based on the school you choose, do you meet the individual STATE's residency requirements for determination of in-state versus out-of-state tuition fees, if applicable

My daughter and I created the following video after our Mexican-born neighbors (who were in the US illegally) and their three-year-old (American-born) daughter were forced to move to another town by a bullying police officer. My two daughters were good friends with the three-year-old and they were very disappointed that she had to go. I, myself, was very fond of the family too, but my own attempts to help and protect the family failed. My daughter asked me if there was something SHE could do. Creating a cool video was the best I could think of. My daughter and I both had fun making the video. We hope you enjoy watching it...

1. Nothing needs to be notarized. You can send in photocopies of everything. The marriage certificate that you photocopy should be the real certified copy. but you only send in a photocopy of it.
2. There is no list is translators, and some people do it themselves and attest to their own language ability. I didn't know this when we applied, so I found a "certified" translation company by googling and they translated the document very professionally. It wasn't expensive, and they did it in one day. Do whatever you feel comfortable with
3. You should go have your medical exam before you send your packet. You must see a "Civil Surgeon," not a regular doctor. Civil Surgeons are regular doctors who have an extra certification to do immigration medical exams. They will fill out form I-693 and give it to you in a sealed envelope. You should send in this sealed envelope with your submission.
4. AP is routinely approved for pending I-485s. You don't even have to explain why for t to be approved. However, I do have a wrench to throw in your works (sorry!). You will have a mandatory interview in the US where both you and your husband are required to be present. If you plan to be in Finland all of June and July, I am going to guess that your interview will fall in there sometime. You would need to have someone checking your mail (and a permanent address, you can't have no place to live here) and also be ready to fly back to the US for your interview. They usually give you about a month's notice for the interview date.

yes, you are correct, you have a problem, and it's a big one.
See, the B1/B2 is a non-immigrant visa. Not only have you been inspected, but you have been pulled into what is known as "secondary" inspection. The fact that you have such documents with you on a vacation indicates immigration intend. You were specifically asks about this and you . . . uhhh . . . lied when telling CBP that you felt insecure leaving those documents at home.
I am absolutely sure that CBP entered your statement, and that's what that is, into the computer under your file. The way I understand your post, you now got married and are planing to adjust status. If you do that, you will be denied based on material misrepresentation. It carries a lifetime ban from the United States.
If I were you, I would return to Vietnam and take the CR-1 route. Seriously.

I picked up a commercial building 3 weeks ago, on 3 acres of land.
The owners wanted 4 months to 'move out', so we have nice sales contract on that, they're paying me a monthly lease
and waaaaaaaaaaay in the back, I've moved in 2 old Victorian Houses that were 'thrown away' by some other land owners, they gave them to me.
The asking price on the commercial property was about 1/6 of it's value, I got nice loan on 1/2 of it's value, having fun with the new cash. I like new cash, always.
The commercial property reminds me of 'What would it look like if Frank Lloyd Wright designed a commercial property?' Property prices in Irving are really depressed right now, but property values are NOT.
Sounds like yer having fun training up yer realtor !! Yay !

I will answer ur questions honestly based on my own experience. I met my husband online in 2003 and we chatted everyday for 3 long years before he finally came to the Philippines to met me in person. We are now happilly married for almost 4 years with a 2 yr. old baby plus my 2 kids.
To answer ur questions:
1. Will it work? Yes but it will all depends to both of u if uare willing to do whatever it takes to make ur relationship works.
2. Yes..just make urself busy so u won't get homesick. Do volunteering, Join organizations etc. etc.
3.Yes the same thing if u were to ask will u love him for the rest of his life? Are u willing to commit urself into him and to ur marriage. Marriage is not all a bed of roses..there are all the time UPS and DOWNS...it's a matter of choice if u are willing to live with him in good and in bad, for better or for worst. We all need to work in our marriage.
I admit we had so many trials during the first year of marriage(adjustment period) but I am thankful to God my husband is just being soooo patient and understanding (despite of me having 2 kids of my own).
4.Not exactly 100 %. U will never know the true color of a person till u live with him. Like I said ask urself the same question. Will ur husband feels the same way u do? Will u not change and show ur real self when ur together by then? When i came here 4 yrs. ago i have no relatives just myself and had to leave my family and my 2 kids to be with my husband.
No matter what,,we always put or best foot forward when we are in the dating or getting to know each other stage.But real color comes out when u live with each other. But i learned a lot. When u commit ur self to ur marriage and willing to compromise and put ur best effort on it..then there is nothing impossible. A happy marriage is not all about money.
Marriage is not all about happiness,,it's also about sacrifice, patience, believing and FAITH in him is the most important.
I tell u my hubby was unemployed for more than 16 months and was in the middle of petitioning my 2 kids when he lost his job.. I was not working then. But LOVE conquers all.. God made a way. I got a good job now(working at the hsptal-) and my 2 kids are finally here with us.
Believe in HIM and He will find a way.

Must be married within 90 days. If not married, then is best to return back to your home country.
You getting an SSN is easy, regardless of 'next status', if yer diligent at the SSA office about 2 weeks from yer POE date.
You getting an EAD - sure -it's possible, but it will expire ON THE DAY of yer I-94's expiration date.

Moving to AOS forum...
1) You WILL need another medical exam, you will need to visit a US Civil surgeon and have a full I-693 done. USCIS only considers foreign medical to be valid only 1 year no-matter what it says on the medical.
2) File I-485, and I-765 using name that you wish to be on your cards, if married name then use married name. Forms have lines for "Other names used" and "name on I-94" there is where you place maiden name. Getting a name change after getting a green-card involves filing an I-90 and paying a $450 FEE.
Dont bother with I-131, your have overstayed the I-94 by well more than 180 days, so WILL be bared re-entry if travel abroad while I-485 is pending, AP wont allow re-entry, or over-ride the bar.

Really? I've never heard of that particular law. As far as I know, they can "make judgment" based on anything they like. The law gives them that discretion.
