  1. Sister's case would also be current sometime in the 2040's He cant adjust status, presumably the plan is then to file I 601a? Assuming it is still around? Assuming there is no other issues as that only covers illegal presence. Then interview at the Consulate. Withholding of Removal strongly suggests a Lawyer is involved not DIY. Perhaps OP would be best talking to the Lawyer, but son and sister should be fully aware of what is going on.

  3. If you filed for him before 2011 ish then that is possible, I would use your Congressperson.
  4. If you have yet to file for him it will be over 14 years before there is anything to expedite. Not sure an expedite would even apply anyway. I do not see a basis.
  5. Like I said this is the first case I have seen where someone was able to use the U4U to get out of Russia. Asylum cases take a very long time and I think it would be reasonable to believe that her AOS through her child would come first.
  6. So you have not filed for him, he is obviously over 21. Are you a USC? Is he married to a USC? Sounds like he has a Witholding of Removal.

  9. The local media said they had come from Kuwait, children may have been born there and that the daughter who graduated had been at the school for 2 years. My current assumption is that they got their Bs in Kuwait. So lets say the wife and children are derivatives on his asylum claim, the basis of which is still a mystery, seems his actions contradict any claim, I would think that would be fast tracked so they could be deported.
  10. She was able to get out of Russia, I could see that working, I think all the U4U cases I have seen is where people have left Ukraine. The Parent of a USC route will be a lot quicker, Asylum can take forever. I cant tell how these are processing, I have seen the pause mentioned but that is recent and I can not tell if it actually happening. Did she apply for EAD as part of her adjustment? She has the NoA?

  12. Sounds like you were not at the interview, you will with a Spousal visa be given the opportunity to rebut whatever was the reason for the denial

  15. I nearly went to Vietnam in 1999 but it was not to be. Now I do know in the UK Travel Insurance is advertised everywhere, and my impression is that a lot more Vietnamese travel now so assume there must be lots of options. Obviously not cheap, well if it is there will be issues, the biggest lelemts is obviously Medial and Emergency Travel costs, make sure the limits are high. My Mum was getting on and her Insurance was about the same as the flight for 2 weeks.

  17. I used to live near Boulder and spent a lot of time there, know people now who live there or in the area, actually someone I know is married to a Jewish lady.   20. Some Consulates are particularly hot on Domicile, if he is going to go DCF then he will have a job by definition and will no doubt have started it by the time of the interview.
  21. I was just thinking of Hacking, missed his show on my lunch break now. His wife is Egyptian and wonder how he responded, will watch later. Anyone can make an Asylum claim and then in 10 years whatever worry about it then. Hacking had a lady on a few weeks back and she was talking about her Asylum claim and I was thinking well she is speaking with a northern non indigenous regional accent. Anyway he did not realise and it went on for a while before he asked her where she was from, UK. Hacking also converted, and most of his asylum calls are from Muslim countries also a bit odd if you think about it. Did occur to me that I could have made a passable asylum claim if I went before the more lenient Courts. And also that here we have Asylum being used which originally came about as a response to Jews fleeing Axis countries being used by someone who attached a Holocaust survivor. Crazy crazy world. Anyway seems he flew into LA, my guess is that they were coming to see the Mouse whatever, he seems to have enough money to have kept well fed.
  22. Watching the news, Channel 9, this is very awkward for them. They said he has a wife and 5 children in the Springs. I assume they all came as tourists, suppose he could have married a ready made family when he got here? If he has EAD and a lot of reports he does, well asylum or being sponsored by a new US wife would be the only realistic ways? Issuing visitor visas to asylum producing countries is slightly off, contradictory. I like watching Hacking and it seems most of his dodgy cases involve a Visitor visa entry, and you always wonder how they ever got one.
